Abstract
O objetivo do presente artigo é analisar as dificuldades de produção de prova nos
crimes cibernéticos, dada a volatilidade das provas que são produzidas por esses crimes. Com
a difusão de novas tecnologias, em todo mundo, se mostra necessário uma análise apurada desse
fenômeno global. Para tanto, foi realizado um breve estudo histórico da evolução da rede
mundial de computadores e os principais aspectos de como esse meio de interação
multidisciplinar impactou as relações sociais, principalmente no que se refere ao direito penal
e processual penal brasileiro. O estudo visa abordar as principais leis do ordenamento jurídico
brasileiro de crimes cibernéticos e efetuar um comparativo com a legislação internacional, com
destaque à Convenção de Budapeste e às leis nacionais; a Lei da Carolina Dieckman, e o Marco
Civil da Internet.
The purpose of this paper is to analyze the difficulty of producing evidence in cyber crimes, given the volatility of the evidence that is produced by cyber crime. With the diffusion of new technologies, an analysis of this global phenomenon is needed. To this end, a brief historical study of the evolution of the worldwide computer network was conducted and the main aspects of how this multidisciplinary mean of interaction had an impact on social relations, especially with regard to Brazilian criminal and procedural criminal law. The study aims to address the main laws of the Brazilian legal system and make a comparison with international law, highlighting the Budapest Convention, the Carolina Dieckman Law, and the Internet Civil Framework.
