Sabe-se que a saúde é um direito fundamental de extrema importância e dele o ser humano depende para se desenvolver em seu esmero. Assim, é dever do Estado assegurar esse direito para todos. Dessa forma, este artigo objetiva discutir as cláusulas abusivas na relação consumerista envolvendo operadoras de planos de saúde, assim como identificar as abusividades presentes neste tipo de contratação reconhecidas pela doutrina e jurisprudência. Para tanto, utiliza-se a metodologia de pesquisa bibliográfica que consiste, basicamente, na leitura e análise das teorias dos principais autores do Direito que tratam do tema em análise, bem como a análise da jurisprudência recente. Ao início do trabalho são explorados os planos de saúde e sua forma de atuação, seguindo com o estudo sobre a relação de consumo e a proteção do consumidor vulnerável e, por fim, as espécies de cláusulas abusivas existentes nestes contratos, bem como de que forma a legislação protege o consumidor dessa prática abusiva.
It is known that health is, above all, a fundamental and extremely important right for human beings to develop with care. Thus, it is the duty of the State to ensure this right for all. Thus, this article aims to discuss the abusive clauses in the consumer relationship involving health plan operators, as well as to identify the abusiveness present in this type of contracting recognized by doctrine and jurisprudence. In order to do so, a bibliographic research methodology is used, which basically consists of reading and analyzing the theories of the main authors of Law that deal with the subject under analysis, as well as the analysis of recent jurisprudence. At the beginning of the work, the health plans and their way of acting are explored, following with the study on the consumption relationship and the protection of the vulnerable consumer and, finally, the species of abusive clauses existing in these contracts, as well as in what way the legislation protects the consumer from this abusive practice.
