dc.description.abstractA Teoria da Causa Madura é um instituto processual civil de celeridade que possibilita o julgamento do mérito do processo diretamente pela segunda instância, em sede de apelação. O objetivo deste trabalho é analisar a possibilidade de extensão da aplicação da Teoria da Causa Madura aos julgamentos de agravos de instrumento. A questão reside no fato de esse instituto estar previsto especificamente nos artigos de lei referentes à apelação, além de dissídio jurisprudencial sobre o assunto. A hipótese aqui levantada é a de que a extensão da aplicabilidade é totalmente cabível por conta de características semelhantes entre as duas modalidades recursais. Para tanto, a pesquisa foi desenvolvida pelo método hipotético-dedutivo quanto à norma e por meio da análise qualitativa do entendimento doutrinário e jurisprudencial.pt_BR
dc.description.abstractThe Mature Cause Theory is a civil procedural institute of celerity that allows the trial of the merit of the case directly by the second instance, on appeal. The purpose of this paper is to analyze the possibility of extending the application of the Mature Cause Theory to judgments on interlocutory appeals. The issue resides in the fact that this institute is specifically foreseen in the articles of law that refer to appeal, besides the jurisprudential dissension on the subject. The hypothesis raised here is that the extension of the applicability is fully applicable because of the similar characteristics between interlocutory and regular appeals. To this end, the research was developed by the hypothetical-deductive method regarding the norm and by means of a qualitative analysis of the doctrinaire and jurisprudential understanding.pt_BR
