Resumo
A democracia trouxe e apregoou à tessitura social princípios e direitos que a
caracterizam. É fácil identificar as liberdades de um Estado Democrático de Direito
justamente porque, durante a história, a humanidade já foi violentamente privada de muitas
delas, o que as tornam hoje particularmente preciosas. Em contrapartida, essas mesmas
liberdades podem se transformar em instrumento de violação de direitos de terceiros e
fomentar o desrespeito e a intolerância. A liberdade de expressão e o racismo são,
respectivamente, o símbolo de um direito que a democracia conquistou e o efeito colateral que
ela gera, ou quando não, potencializa. É sob essa controvérsia, sob essa dualidade em termos
democráticos que este trabalho traz à tona a discussão sobre a legalidade da comercialização
de um livro tão paradoxal como “Minha Luta”, de Hitler. Longe de pretender fixar qualquer
conclusão sobre o tema, o presente estudo visa problematizá-lo, isto é, trazer à reflexão os
argumentos que defendem e os que refutam a comercialização de Mein Kampf sob a ótica da
liberdade de expressão e da incitação ao preconceito e à discriminação.
Democracy brought and proclaimed to the social weaving principles and rights that now feature it. It’s easy to identfy the freedom that’s part of the rule of law exactly because, during history, humanity has already been violently deprived of many aspects of it, which makes it particularly precious nowadays. On the other side, such freedom may turn into intolerance. Freedom os speech and racismo are, respectively, symbols of a righ that democracy has conquered and a side effect it generates, or when it’s not the case, we can say it leverages it. It’s regarding this controversy, this duality when it comes to democracy, that this article brings up the discussion about the legality of the commercialization of a paradoxical book such as My Fight, by Hitler. Far from intending to fixate any conclusion about the theme, this study wishes to problematize it, which means bringing up for reflection the arguments that defend and those that refute the commercialization of Mein Kampf by the optics of freedom of speech and instigation of prejudice and discrimination
