A Moda, como criação humana a fim de proteger o corpo da nudez e dos fatores externos, está
presente na sociedade desde seus primórdios. Passando por uma grande evolução de estilos e
sistemas de produção, a automação e principalmente a Revolução Industrial foram
determinantes para a democratização da Moda. Atualmente, o fenômeno do Fast Fashion
alterou o sistema de produção e consumo de vestimentas. Trata-se de um movimento de
produção constante de peças de vestuário, movido pelo alto consumismo das sociedades
modernas, em que há uma exaustiva fabricação de bens e uma utilização desenfreada de
matérias-primas e mão de obra. Nesse sentido, possui relação intrínseca com os Direitos
Humanos, especialmente o Direito ao Trabalho Digno e à Sustentabilidade, frequentemente
sacrificados em nome dessa produção extensiva dos artigos de Moda. No entanto, com uma
crescente consciência dos consumidores da moda rápida, surgiu uma mentalidade diferente que
pretende assegurar uma cadeia de produção de roupas mais sustentável, social e
ambientalmente. Esse novo mindset utiliza-se do Direito como garantidor e instrumento de
concretização dos seus ideais. Desse modo, neste trabalho, pretende-se averiguar como a noção
de sustentabilidade, social e ambiental, vem alterando os padrões da moda rápida através do
Direito da Moda.
Fashion, as a human creation made to protect the body from nudity and external factors, has been present in society since its beginnings. Going through a great evolution of styles and production systems, automation and especially the Industrial Revolution were decisive for the democratization of Fashion. Currently, the phenomenon of Fast Fashion has changed the system of production and consumption of clothing. It consists of constant production of garments, driven by the high consumerism of modern societies, in which there is an exhaustive manufacture of goods and an unrestrained use of raw materials and labor. In this sense, it has an intrinsic relationship with Human Rights, especially the Right to Decent Work and Sustainability, which are often sacrificed in the name of this extensive production of Fashion articles. However, with a growing awareness of consumers of fast fashion, a different mindset has emerged that aims to ensure a more sustainable clothing chain, socially and environmentally. This new mindset uses Law as a guarantor and an instrument for the realization of its ideals. Thus, in this work, we intend to investigate how the notion of sustainability, social and environmental, has been changing the patterns of fast fashion through Fashion Law.
