O presente trabalho buscou apresentar a responsabilidade civil em meio a atividade
médica, discutindo a natureza jurídica da obrigação assumida pelo médico na cirurgia plástica
estética, confrontando o entendimento majoritário da doutrina e jurisprudência atual, as quais
entendem que a referida modalidade cirúrgica deve ser encarada como obrigação de resultado,
divergindo da regra geral aplicada as outras áreas do exercício profissional, considerada como
obrigação de meio. Para tanto, o trabalho foi realizado de modo a afunilar o conteúdo,
iniciando-se com uma análise geral da responsabilidade civil e partindo para as
especificidades de tal instituto na atividade médica e no âmbito da cirurgia plástica
embelezadora. Foi apresentada a responsabilidade civil, sua função, seus pressupostos e seus
desdobramentos. Após, foi explanada a relação médico-paciente, as peculiaridades da
profissão, as obrigações a serem observadas e a natureza jurídica da responsabilidade civil
neste contexto. Por fim, a responsabilidade civil foi analisada no âmbito da cirurgia plástica
estética, diferenciando a de caráter reparador, e explanando fundamentos quanto a
classificação da natureza jurídica da obrigação, observando a responsabilidade profissional
somente quando presente o elemento culpa. Desse modo, o objetivo foi analisar e esclarecer
como deve ser encarada a responsabilidade civil do cirurgião plástico quando da realização de
procedimento estético, concluindo-se pela melhor adequação ao entender que a obrigação
deve ser analisada como de meio, sendo imprescindível a presença da culpa para o ensejo da
responsabilização. Para que fosse solucionado o problema de pesquisa, foram citados
comentários de doutrinadores, apresentados conceitos, decisões judiciais e pontuados os
artigos legais sobre o tema. Para tanto, a abordagem realizada foi qualitativa, tendo sido
adotada a pesquisa descritiva na abordagem.
The present work sought to present the civil liability present in the medical activity, discussing the legal nature of the obligation assumed by the doctor in aesthetic plastic surgery, confronting the majority understanding of the current doctrine and jurisprudence, which understand that the aforementioned surgical modality must be seen as an obligation of result, diverging from the general rule applied to other areas of professional practice, considered as an obligation of means. Therefore, the work was carried out in order to narrow the content, starting with a general analysis of civil liability and starting with the specifics of such an institute in medical activity and in the scope of beautifying plastic surgery. Civil liability, its function, its assumptions and its consequences were presented. Afterwards, the doctor-patient relationship, the peculiarities of the profession, the obligations to be observed and the legal nature of civil liability in this context were explained. Finally, the civil liability was analyzed in the scope of aesthetic plastic surgery, differentiating that of a reparative nature, and explaining the grounds for the classification of the legal nature of the obligation, observing the professional responsibility only when the fault element is present. In this way, the objective was to analyze and clarify how the civil liability of the plastic surgeon should be faced when performing an aesthetic procedure, concluding that the best suitability is to understand that the obligation must be analyzed as a means, being essential the presence of guilt for the purpose of accountability. In order to solve the research problem, comments from scholars were cited, concepts, judicial decisions were presented and legal articles on the subject were punctuated. For that, the approach was qualitative, having been adopted the descriptive research in the approach.
