dc.description.abstractO presente trabalho tem como objetivo verificar a possibilidade do dano moral por circunstância do abandono afetivo, destacando o entendimento jurisprudencial, sobretudo do Superior Tribunal de Justiça. Para tanto, abordou-se a corrente positiva e negativa do dano moral por abandono afetivo, bem como, o que diz a doutrina a respeito da possibilidade e da impossibilidade dessa indenização. Por fim, foi feita uma pesquisa para compreender a aplicação do tema no Superior Tribunal de Justiça. Para o estudo dos referidos temas, a pesquisa foi realizada sob o método de abordagem qualitativo, o método de procedimento utilizado foi o descritivo e a técnica de pesquisa foi a pesquisa jurisprudencial e bibliográfica. Conclui-se que a reparação civil dos danos decorrentes do abandono afetivo é uma forma de minimizar o sofrimento daquele que foi privado de afeto, pois de fato não se espera que uma indenização alcance a construção de uma relação de carinho, afeto e cuidado. O que se visa é obter o efeito compensatório, ou até mesmo punitivo, com vistas a privilegiar a dignidade da pessoa humana.pt_BR
dc.description.abstractThe present work aims to verify the possibility of moral damage due to affective abandonment, highlighting the jurisprudential understanding, especially of the Superior Court of Justice. Therefore, the positive and negative current of moral damage through affective abandonment was approached, as well as, what the doctrine says about the possibility and impossibility of this indemnity. Finally, a survey was carried out to understand the application of the topic at the Superior Court of Justice. For the study of these themes, the research was carried out under the qualitative approach method, the method of procedure used was the descriptive and the research technique was the jurisprudential and bibliographic research. It is concluded that the civil reparation of damages resulting from affective abandonment is a way of minimizing the suffering of those who have been deprived of affection, because in fact it is not expected that an indemnity will reach the construction of a relationship of affection, affection and care. The aim is to obtain a compensatory, or even punitive, effect, with a view to privileging the dignity of the human person.pt_BR
