Este artigo tem como objetivo analisar e discutir a competência do Juízo da Recuperação Judicial para analisar casos de constrição contra a Recuperanda quando se tratar de crédito não sujeito à sua Recuperação Judicial, bem como analisar o art. 6o, §§ 7o-A e 7o- B da Lei de Recuperação Judicial e Falência, que foram introduzidos com a Lei no 14.112, de 24 de dezembro de 2020. Além disso, o trabalho irá discorrer sobre quais são as vantagens e desvantagens para o devedor que precisar quitar o crédito extraconcursal e ao mesmo tempo se encontra em uma situação financeiramente vulnerável, não podendo ter seus recursos e bens expropriados para não prejudicar o seu soerguimento, e sobre quais serão os maiores desafios para os credores que estão em busca de seus créditos extraconcursais e que não conseguem satisfazer a execução contra empresa que se encontra em Recuperação Judicial.
This article aims to analyze and discuss the competence of the Court of Judicial Reorganization to analyze cases of constriction against the Company under Reorganization when dealing with credit not subject to its Judicial Reorganization, as well as to analyze art. 6th, §§ 7th-A and 7th-B of the Judicial Reorganization and Bankruptcy Law, which were introduced with Law 14.112, of December 24, 2020. In addition, the work will discuss the advantages and disadvantages for the debtor who needs to settle the extra-bankruptcy credit and at the same time finds himself in a financially vulnerable situation, not being able to have his resources and assets expropriated in order not to harm his uplift, and what will be the biggest challenges for creditors who are looking for their extra-bankruptcy credits and that they are unable to satisfy the enforcement against a company that is in Judicial Reorganization.
