O presente trabalho se destinou a investigar a ocupação da população negra no mercado de trabalho, especificamente nos cargos de chefia, direção e liderança, a partir da promulgação da Constituição Federal de 1988. O metódo utilizado foi o levantamento bilbiográfico e a abordagem foi qualitativa. Foram analisadas as disposições constitucionais, os compromissos internacionais ratificados, bem como a legislação infraconstitucional, que evidenciam o anseio por igualdade e justiça social do Estado. Após um levantamento e análise de dados produzidos entre 2016 e 2021 acerca da ocupação da população negra nos cargos de alto escalão, verificou-se que, apesar da proteção constitucional, os negros não estão devidamente inseridos nos referidos cargos. O racismo institucional foi apontado como uma das causas da desigualdade racial. Em alternativa a este quadro, as políticas públicas de promoção da igualdade racial se apresentam.
The present work was intended to investigate the occupation of the black population in the labor market occurred, specifically in the oppositions of leadership, direction and leadership, after the promulgation of de Federal Constitution of 1988. The method used was the bibliographical survey and the approach was qualitative. Constitutional provisions, ratified international commitments, as well as infra-institutional legislation were raised, which demonstrate the State’s desire for equity and social justice. After a survey and analysis of data produced between 2016 and 2021 about in the occupation of the black population in the high-ranking positions, it was found that, despite constitutional protection, blacks are not properly included in the aforementioned high-level positions. Institutional racism was identified. As an alternative to this framework, public polices to promote racial equity are presented.
