O presente trabalho tem o objetivo de analisar a aplicação da responsabilidade penal em
acidentes aéreos, no plano internacional e nacional, com enfoque no tipo penal do artigo 261
do Código Penal. Dessa forma, abordou-se a responsabilidade penal dos principais
profissionais aeronáuticos envolvidos na operação de um voo, como pilotos, copilotos,
controladores aéreos, gerentes de empresas aéreas, engenheiros e mecânicos. Para uma
melhor compreensão, realizou-se um estudo de caso particularizado de três acidentes aéreos
emblemáticos na aviação comercial brasileira: VARIG 254, GOL 1907 e TAM 3054. Para
isso, empregou-se uma metodologia de pesquisa exploratória com abordagem qualitativa,
baseada em pesquisa bibliográfica, jurisprudencial e documental. Assim, o trabalho visa
demonstrar a importância do estudo da responsabilidade penal em acidentes aéreos, uma vez
que, na cadeia de eventos que culminam em um acidente aeronáutico, por diversas vezes,
condutas são caracterizadas como crimes e, portanto, urge a responsabilização penal. Por fim,
pretende-se mostrar que a conscientização jurídica da comunidade aeronáutica e a capacitação
da comunidade jurídica sobre a atividade aviatória são a melhor solução na busca pela
segurança aérea e a proteção da vida humana.
This paper aims to analyze the application of criminal liability in aviation accidents, both internationally and nationally, focusing on the criminal type under Article 261 of the Penal Code. Thus, it addressed the criminal liability of the main aeronautical professionals involved in the operation of a flight, such as pilots, co-pilots, air traffic controllers, airline managers, engineers, and mechanics. For better understanding, a detailed case study of three emblematic air accidents in Brazilian commercial aviation was conducted: VARIG 254, GOL 1907, and TAM 3054. For this purpose, an exploratory research methodology with a qualitative approach was employed, based on bibliographic, jurisprudential, and documentary research. Therefore, the work aims to demonstrate the importance of studying criminal liability in air accidents, since, in the chain of events that lead to an aeronautical accident, behaviors are often characterized as crimes, and thus, prompt criminal accountability is necessary. Finally, it intends to show that legal awareness within the aeronautical community and the training of the legal community about aviation activities are the best solutions in the pursuit of air safety and the protection of human life.
