Ao longo da história, verificou-se uma crescente na quantidade de trabalhadores que optaram por direcionar a prestação dos seus serviços para países estrangeiros. Antigamente, esse cenário por muitas vezes se dava em decorrência de necessidade. Atualmente, verifica-se a qualificação e especialização de mão de obra que, atraída por uma série de benefícios, busca firmar contratos internacionais de trabalho, os quais acabam por enfrentar questionamentos acerca das normas a eles aplicáveis, bem como da competência jurisdicional para julgar divergências deles decorrentes. A análise desses conflitos será feita à luz do conceito de trabalhador hipersuficiente, abordado no parágrafo único do artigo 444 da CLT, incluído com a Reforma Trabalhista. Referido dispositivo aborda a possibilidade de livre estipulação entre empregado e empregador, com mesma eficácia legal e preponderância sobre os instrumentos coletivos, na hipótese de o empregado possuir diploma de ensino superior e perceber salário mensal igual ou superior a duas vezes o limite máximo dos benefícios do Regime Geral de Previdência Social. Dessa forma, o presente trabalho traz uma análise dos contratos internacionais de trabalho firmados com empregados hipersuficientes, bem como os conflitos normativos, jurisdicionais e de competência decorrentes desses contratos, considerando o caráter protetivo do Direito do Trabalho brasileiro. Ao final, o presente trabalho propõe uma nova visão para o conceito de trabalhador hipersuficiente com a introdução da ideia de uma menor ingerência da Justiça do Trabalho a esse tipo de relação, para viabilizar o melhor exercício da autonomia privada das partes.
Throughout history, there has been an increase in the number of workers who chose to direct the provision of their services to foreign countries. In the past, this scenario often occurred because of necessity. Currently, there is the qualification and specialization of workforce that, attracted by a series of benefits, seeks to sign international employment contracts, which end up facing questions about the legislation applicable to them, as well as the jurisdictional competence to judge divergences arising from them. The analysis of these conflicts will be done considering the concept of hypersufficient worker, addressed in the sole paragraph of article 444 of the CLT, included by the Labor Reform. Said provision addresses the possibility of free stipulation between employee and employer, with the same legal effectiveness and preponderance over collective instruments, when the employee has a university degree, and receives a monthly salary equal to or greater than twice the maximum benefit limit of the General Social Security Regime. Therefore, this work presents an analysis of international employment contracts signed with hypersufficient employees, as well as the normative, jurisdictional and competence conflicts arising from these contracts, considering the protective nature of Brazilian Labor Law. In the end, this work proposes a new vision for the concept of hypersufficient worker with the introduction of the idea of less interference by the Labor Court in this type of relationship, to enable the best exercise of the parties' private autonomy.
