Abstract
O acesso dos alunos com deficiência às escolas regulares configura um grande avanço. Este avanço é reflexo da luta dos movimentos em prol da inclusão social da pessoa com deficiência, contudo, ainda existem diversas barreiras a serem transpostas. Nesse sentido, o presente trabalho tem como tema central a análise da legislação brasileira que ampara a educação inclusiva, a fim de averiguar sua eficácia social e seus impactos na educação da pessoa com deficiência. Para tanto, foi realizada uma pesquisa qualitativa através da análise de fontes primárias (legislação nacional e internacional) e secundárias (artigos e estudos científicos), que permitiram a confirmação da hipótese de que, apesar dos avanços, apenas a legislação vigente não é capaz de assegurar o exercício pleno da educação inclusiva.
Access to the general schools for people with disabilities is an advance. This advance reflects the struggle of the movements in favor of the social inclusion of the people with disabilities, however, there are still several barriers to be overcome. The main theme of this paper is the analysis of the Brazilian legislation dealing with inclusive education with the purpose of ascertaining its effectiveness and impacts on the education of people of disabilities. For this purpose, it was made a qualitative research dedicated to the analysis of the primary sources (national and international legislation) and secondary sources (scientific papers) which allowed the confirmation of the hypothesis that, despite advanced in inclusive education, only the law in force is unable to insure the exercise of rights.
