Abstract
A monografia apresentada tem como sua principal premissa abordar as diferentes
técnicas de clonagem existentes e desmistificá-las à luz do direito bandeirante e da
ciência biomédica, bem como estudar a dificuldade apresentada pela ciência jurídica em
acompanhar o desenvolvimento sócio-científico em solo pátrio.
Dito isto, o trabalho dará especial atenção as técnicas de clonagem, derivadas da
engenharia genética e revolucionárias em vários sentidos, presenciadas principalmente
no campo vegetal e no animal, entretanto, como toda nova descoberta, devemos também
apontar e estudar seus possíveis malefícios.
As grandes mudanças sócio-científicas que vivenciamos nos últimos tempos
provocaram na comunidade jurídica a necessidade de especialização, na tentativa de
melhor dirimir os conflitos que foram e são gerados e, assim, por conseqüência direta,
presenciamos o desenvolvimento de um novo ramo na ciência do direito, o Biodireito.
O estudo busca entender as diferentes perspectivas ante aos dilemas da clonagem, bem
como relacionar os pontos de intersecção da ciência biomédica com os vários ramos do
direito, demonstrando a sua grande importância para a fluidez, celeridade e conclusão
de processos jurídicos. Não obstante, tenta entender a complexa, porém, existente
ligação entre direito, religião e ciência, e assim, refletir sobre os seus desdobramentos
dentro da sociedade e o papel exercido por cada um dos segmentos.
Por fim, apontar o que possuímos de legislação e textos de lei que versem sobre a
clonagem, engenharia genética, proteção ao patrimônio genético e vedação a Eugenia,
com a reflexão crítica sobre a eficácia dos ordenamentos jurídicos existente e o que
poderia ser alterado, em detrimento daquilo do que há de mais novo na ciência
biomédica.
The monograph presented has as its main premise, to approach the different existing cloning techniques and to demystify them in the light of "Bandeirante" law and biomedical science, as well as to study the difficulty presented by legal science in accompanying socio-scientific development in homeland. Nevertheless, the paper will set forth special attention to cloning techniques, derived from genetic engineering and revolutionary in several senses, witnessed mainly in the plant and animal fields, however, like any new discovery, we must also point out and study their possible harm. The great socio-scientific changes that we have experienced recently have caused the need for specialization in the legal community, in an attempt to better resolve the conflicts that were and are generated, as a direct consequence, we witnessed the development of a new branch in the science of law, the Biodireito. The study seeks to understand the different perspectives facing the dilemmas of cloning, as well as to relate the points of intersection of biomedical science with the various branches of law, demonstrating its great importance for the fluidity, speed and conclusion of legal processes. At the same time, it tries to understand the complex, however, existing link between law, religion and science, and thus, reflect on its developments within society and the role played by each of the segments. Finally, to point out what we have of legislation and law texts that deals with cloning, genetic engineering, protection of genetic heritage and prohibition from Eugenia, with a critical reflection on the effectiveness of existing legal systems and what could be changed to the detriment of what we have as the newest in biomedical science.
