| dc.description.abstract | Esta dissertação analisa a Cédula de Produto Rural Eletrônica (CPR-e) como um instrumento financeiro para fomentar o crédito agrícola no Brasil, sendo abordadas questões que envolvem a segurança jurídica da nova modalidade do título, tais como o benefício da substituição da cédula em papel (cartular), custos e emolumentos cartorários para emissão, endosso, registro e baixa do título de crédito, impacto nos custos relacionados ao crédito agrícola, dicotomias sobre o registro da CPR-e e das respectivas garantias do título, respaldo pela legislação brasileira sobre a nova modalidade da CPR e temas a serem regulados, assinatura eletrônica em títulos de crédito e força executiva do título. Para tanto, se fez uma retrospectiva dos marcos regulatórios do direito do agronegócio, dos princípios dos títulos de crédito e especificamente da Cédula de Produto Rural, a fim de abordar os aspectos jurídicos e a segurança jurídica dos títulos de crédito eletrônicos do agronegócio, especialmente da CPR, e como a eletronificação do título pode possibilitar o fomento do crédito agrícola privado no Brasil, fazendo uma leitura de quais seriam os impactos e os benefícios jurídicos e econômicos em razão da emissão da Cédula de Produto Rural Eletrônica. | |

| local.description.abstracten | This dissertation analyzes the Electronic Rural Product Note (CPR-e) as a financial instrument to foster agricultural credit in Brazil, addressing issues involving the legal certainty of the new type of credit instrument, such as the benefit of replacing the paper note (cartouche), costs and notary fees for issuance, endorsement, registration and write-off of the credit instrument, impact on costs related to agricultural credit, dichotomies on the registration of the CPR-e and the respective guarantees of the credit instrument, supported by Brazilian legislation on the new modality of the CPR and topics to be regulated, electronic signature on credit securities and executive force of the credit instrument. To this end, a retrospective of the regulatory frameworks of agribusiness law, the principles of credit securities and specifically the Rural Product Note, was made in order to address the legal aspects and legal certainty of agribusiness electronic credit securities, especially the CPR, and how the electronicization of the credit instrument can enable the promotion of private agricultural credit in Brazil, making a reading of what would be the impacts and the legal and economic benefits due to the issuance of the Electronic Rural Product Note. | |
