O presente artigo pretende analisar os limites e possibilidades da concessão da “licença menstrual” ou “licença menstruação” face ao cenário de contratação no mercado de trabalho, princípios constitucionais e normas trabalhistas brasileiras. Para esse propósito, foi utilizado o método hipotético-dedutivo em uma pesquisa bibliográfica e exploratória, ressaltando-se alguns países que adotaram esse tipo de licença. Considerando o direito constitucional e trabalhista e com base nos princípios como dignidade da pessoa humana, saúde, igualdade e isonomia, em um primeiro momento, discutiu-se a conquista dos direitos da mulher por meio de uma análise da passagem histórica da luta feminina. Em uma segunda etapa analisou-se o fenômeno da dismenorreia, em conjunto com a licença menstrual, relacionados à sua aplicação no Brasil. Concluiu-se que a licença menstrual, poderia se encaixar no atual ordenamento jurídico brasileiro, no entanto, sua normatização na prática, não seria ideal devido às discriminações sofridas pelas mulheres no ambiente de trabalho, isto posto, uma forma mais consciente de se aplicar o benefício, sem fazer com que haja relutância na contratação das mulheres, seria viável por meio da elaboração de políticas internas pela própria empresa.
The present article intends to analyze the limits and possibilities of granting "menstrual leave" or "period leave" in light of the hiring scenario in the labor market, constitutional principles and Brazilian labor standards. For this purpose, the hypothetical-deductive method was used in a bibliographic and exploratory research, highlighting some countries that have adopted this type of leave. Considering the constitutional and labor law and based on principles such as human dignity, health, equality and isonomy, in a first step the conquest of women's rights was discussed through an analysis of the historical passage of the women's achievement. In a second step, the phenomenon of dysmenorrhea was analyzed together with menstrual leave, related to its application in Brazil. It was concluded that the menstrual leave could fit in the current Brazilian legal system, however, its standardization in practice would not be ideal due to the discrimination suffered by women in the workplace, that said, a more conscious way to apply the benefit, without worsening the reluctance in hiring women, would be feasible through the development of internal policies by the company itself.
