O tema do presente artigo é sobre o flagrante preparado no Direito brasileiro e suas distinções em relação ao flagrante esperado. Sabe-se que a prisão em flagrante, além de ter suas hipóteses legais tradicionais previstas na legislação processual penal, possui também algumas modalidades criadas pela doutrina em face de situações peculiares que ocorrem envolvendo tal forma de constrição legal. Dentre elas, duas que se destacam são justamente o flagrante preparado, também denominado provocado, e o flagrante esperado, modalidades essas amplamente discutidas na doutrina e presentes na jurisprudência, sendo a primeira considerada ilegal e a segunda legal. Assim, o objetivo deste trabalho acadêmico consiste em proporcionar uma visão global sobre tais espécies doutrinárias de flagrante, mostrando como elas são tratadas pela doutrina e também pela jurisprudência. Uma vez apresentadas as características gerais de prisão em flagrante, o presente artigo irá introduzir o conceito de flagrante preparado e explorar o porquê de este ser considerado modalidade de crime impossível, e, portanto, ilegal, nos termos da Súmula 145 do Supremo Tribunal Federal. Será também apresentado o Projeto de Lei n. 4246/2015, que tentou legalizar o flagrante preparado. Na sequência, será abordada a questão do flagrante preparado no caso específico de tráfico de drogas, além de sua relação com o Projeto de Lei n. 882/2019, do “Pacote Anticrime”. Por último, serão apresentadas as diferenças entre flagrante preparado e flagrante esperado, bem como algumas críticas importantes feitas pela doutrina acerca do tema.
The topic of the present article is about the prepared flagrante in the Brazilian legal system and its distinctions in relation to the expected flagrante. It is known that the arrest in flagrante delicto, besides having its traditional legal modalities established in criminal legislation, also has a few modalities created by the doctrine in light of peculiar situations that occur envolving this type of legal constriction. Amongst them, two that stand out are precisely the prepared flagrante, also called provoked, and the expected flagrante, widely discussed in the doctrine and present in the jurisprudence, being the first one considered illegal and the second one legal. Therefore, the goal of this academic paper is to provide a global vision about these doctrinal types of flagrante, by showing how they are treated by the doctrine and also by the jurisprudence. Once presented the general characteristics of the arrest in flagrante delicto, the present article will introduce the concept of prepared flagrante and explore the reason why it is considered a modality of impossible crime, and, therefore, illegal, according to the Precedent 145 of Brazilian Supreme Federal Court. It will also be presented the Law Project No. 4246/2015, which tried to legalize the prepared flagrante. Moving forward, it will be addressed the topic about the prepared flagrante in the specific case of drug trafficking, besides its relationship with the Law Project No. 882/2019, from the “Anticrime Package”. Finally, it will be presented the differences between prepared flagrante and expected flagrante, as well as some important observations made by the doctrine surrounding the subject.
