Abstract
O presente artigo aborda a constitucionalidade do sistema de tarifação/tabelamento do
dano extrapatrimonial, inserido pela LEI Nº 13.467/2017, tema de imensa relevância social
frente o impacto real a vida da totalidade dos trabalhadores do Brasil, abordamos a sistemática
introduzida chamada Reforma trabalhista com base na realidade nacional, considerando os
danos sofridos e adequação do §1° do artigo 223-G da CLT ao cenário real do trabalho brasileiro
e seus desdobramentos no que tange a responsabilidade civil. Adotamos a metodologia
revisional bibliográfica, análise documental e de casos para chegar ao cerne da pesquisa. As
inovações trazidas pela reforma trabalhista na seara específica da quantificação do dano
extrapatrimonial são inconstitucionais, vez que não observam os princípios da
proporcionalidade, reparação integral, isonomia além das garantias constitucionais de
dignidade da pessoa humana e não discriminação de qualquer espécie. Com o intuito de explorar
o tema a fundo foi utilizada a melhor doutrina contemporânea especializada aplicada à realidade
fática do direito do trabalho nacional a fim de verificar as necessidades do judiciário fronte a
adequação constitucional do novo sistema de tarifação do dano. E por derradeiro concluímos
pela inconstitucionalidade do §1° do artigo 223-G da CLT.
The present article include the constitutionality of the pricing/tabling system the extra patrimonial damage, inserted by the law N° 13.467/2017, theme of huge social relevance as the real impact to the life of the totality of workers of Brazil, we approached the introduced systematic called labor reform based on the national reality, considering the damage suffered and adequation of the §1° of the CLT article 223-G to the real scenario of Brazilian work and your developments with regards to civil liability. We adopted the bibliographic review methodology, documental and case analysis to reach the core of the search. The innovations brought by the labor reform in the specific harvest of extra patrimonial damage quantification are unconstitutional, as it's doesn't observe the proporcional principles, integral reparation, insomnia beyond the constitutionality guarantees of human person and the non-discrimination of any kind. In order to explore the topic in depth the best contemporary specialized doctrine was used applied to factual reality of the national labor rights with the purpose to verify the necessities of judiciary aiming at the constitutional suitability of the new damage documentation system. Finally, we conclude that §1 of article 223-G of the CLT is unconstitutional.
