| dc.description.abstract | A presente monografia tem como objetivo discorrer sobre o tema de quebra de sigilo de informações no processo penal e sua utilização, bem como o surgimento da figura do juiz de garantias, que atualmente é um assunto objeto de discussões e mudanças legislativas no Brasil. É explicado o funcionamento da quebra de sigilo de dados no decorrer das investigações, considerando que, a forma como essas informações são extraídas e utilizadas envolvem situações sensíveis no tocante à privacidade, proteção de direitos individuais e garantias constitucionais. A partir desse olhar, é feita uma relação da figura do juiz das garantias, responsável por supervisionar todo o processo que envolve a quebra de sigilo de informações, garantindo o respeito aos direitos fundamentais do investigado, bem como os reflexos e consequências dessa medida nas investigações e no processo penal. | |
| dc.description.abstract | This monograph aims to discuss the topic of information confidentiality breach in criminal proceedings and its usage, as well as the emergence of the figure of the "judicial guarantee," which is currently a subject of debate and legislative changes in Brazil. It explains how data confidentiality breaches operate during investigations, considering that the manner in which this information is extracted and utilized involves sensitive issues regarding privacy, protection of individual rights, and constitutional guarantees. From this perspective, a relationship is drawn with the figure of the judicial guarantee, responsible for overseeing the entire process involving information confidentiality breaches, ensuring respect for the fundamental rights of the investigated individual, as well as the impacts and consequences of this measure on investigations and criminal proceedings. | |
