dc.description.abstractO presente artigo tem como objetivo identificar os critérios adotados pela doutrina e pela jurisprudência para aferir a ocorrência de abusividade no exercício do voto do credor após a redação trazida pela Lei nº 14.112/2020, que alterou o texto da Lei de Recuperação de Empresas e Falências nº 11.101/05. Para tanto, será realizada uma análise histórica a partir da revisão bibliográfica que versam sobre o tema, verificando as circunstâncias nas quais o ordenamento jurídico pátrio entende pela ocorrência de abuso de voto. Por fim, se concluirá sobre os efeitos práticos da redação do artigo art. 39, §6º da LRF no processo de recuperação judicial.pt_BR
dc.description.abstractThe objective of this article is to identify the criteria adopted by the doctrine and jurisprudence to assess the occurrence of abusive exercise of the creditor's vote after the wording brought about by Law 14.112/2020, which amended the text of the Company Rehabilitation and Bankruptcy Law Law 11.101/05. To this end, a historical analysis will be made based on the bibliographical review on the subject, verifying the circumstances in which the Brazilian legal system considers the occurrence of voting abuse. Finally, we will conclude on the practical effects of the wording of article 39, §6 of the LRF in the process of judicial reorganization.pt_BR
