Abstract
A Inteligência Artificial (IA) transformará radicalmente as sociedades, sendo frequentemente
apontada como uma das tecnologias mais estratégicas do século XXI. A IA está cada vez mais
presente no cotidiano das pessoas com as mais diversas aplicações, muitas delas inofensivas, como
nos smartphones e nos algoritmos de sugestão de conteúdo em plataformas de streaming, pesquisa
e entretenimento, em geral. Mas há aplicações mais sofisticadas com potencial de impactar a
sociedade, como os sistemas autônomos, presentes em robôs, veículos ou até mesmo armas para
fins militares. Há, nesse sentido, inúmeras preocupações sociais e éticas associadas aos sistemas
de IA que apenas poderão ser mitigados através da regulação. Este artigo discute a regulação da
IA, tanto por meio de instrumentos de soft law quanto por meio das leis, e apresenta o cenário
regulatório da IA através do estudo das iniciativas regulatórias de União Europeia, Estados Unidos
e China. Por fim, analisa também o marco regulatório da IA no Brasil, a partir das experiências
internacionais, com o objetivo de contribuir com uma revisão crítica do projeto de lei em tramitação
no país.
Artificial Intelligence (AI) will radically transform societies, often being pointed out as one of the most strategic technologies of the 21st century. AI is increasingly present in people's lives with the most diverse, seemingly harmless, applications, such as smartphones and content suggestion algorithms on streaming, research, and entertainment platforms in general. But there are more sophisticated applications likely to impact society, such as autonomous systems, in the form of robots, vehicles or even weapons for military purposes. In this sense, there are several social and ethical concerns associated with AI systems that can only be mitigated through regulation. This article discusses the regulation of AI, both through soft law instruments and laws, and presents the regulatory scenario of AI through the study of regulatory initiatives in the European Union, the United States and China. Finally, it also analyzes the regulatory framework for AI in Brazil, based on international experiences, with the aim of contributing to a critical review of the bill in progress.
