dc.description.abstractA técnica da reprodução assistida representa um avanço científico muito importante no campo da genética e biomedicina e tem municiado cientistas e médicos em todo o mundo de uma ferramenta capaz de driblar a infertilidade que acomete milhares de mulheres. Contudo, juntamente com os avanços da técnica surgem também questões pungentes no que concerne a bioética e os direitos da nova vida humana concebida por meio de reprodução assistida heteróloga, na qual é utilizada material genético de uma terceira pessoa desconhecida, quem seja, o doador de gametas. Nesse sentido, frente à nova tendência mundial de priorizar os direitos humanos individuais de paternidade e conhecimento da origem biológica, surge um impasse no que tange esse direito fundamental do indivíduo e a confidencialidade do doador, premissa corolária da reprodução assistida. Destarte, o objetivo do presente trabalho será analisar como a legislação brasileira se posiciona diante de tal problemática e quais são as possíveis consequências da quebra de sigilo do doador de material genético.pt_BR
dc.description.abstractThe technique of assisted reproduction represents a very important scientific advance in the field of genetics and biomedicine and has provided scientists and doctors around the world with a tool capable of circumventing infertility that affects thousands of women. However, along with the advances of the technique, poignant questions also arise regarding bioethics and the rights of the new human life conceived through herteryist assisted reproduction, in which genetic material of an unknown third person, who is, the donor of gametes, is used. In this sense, given the new worldwide trend of prioritizing individual human rights of paternity and knowledge of biological origin, a impasse arises regarding this fundamental right of the individual and the confidentiality of the donor, the corollary premise of assisted reproduction. Thus, the objective of this work will be to analyze how Brazilian legislation is positioned in the face of such a problem and what are the possible consequences of the breach of confidentiality of the donor of genetic material.pt_BR
