| dc.description.abstract | O presente trabalho procura entender o tema dos embriões excedentários e o posicionamento jurídico que circunda o tema. Ainda sem resolução legislativa, as discussões judiciais e as Resoluções do Conselho Federal de Medicina têm tratado dos embriões excedentários diante dessa lacuna jurídica. Este trabalho pretende entender os debates jurídicos voltados aos embriões excedentários e sua eventual destinação, visto que, com a evolução da medicina, a produção de embriões excedentários tem tido um aumento exponencial. Serão apresentados os conceitos de embrião, embrião excedentário e seu papel na Reprodução Humana Assistida. Ainda, será feito o exame aprofundado da principal discussão judicial envolvendo embriões excedentários e das Resoluções que regulamentam sua destinação. Finalmente, procura-se entender o papel da bioética e do biodireito para o debate de tema tão relevante para a constituição familiar na sociedade atual. | pt_BR |
| dc.description.abstract | The present work aims to understand the issue of surplus embryos and the legal position that surrounds such issue. Still without a legislative resolution, the judicial discussions and the Resolutions of the Federal Council of Medicine in Brazil have dealt with surplus embryos in the face of this legal gap. This paper intends to understand the legal debates focused on surplus embryos and their eventual destination, since, with the evolution of medicine, the production of surplus embryos has had an exponential increase. The concepts of embryo, surplus embryo and their role in Assisted Human Reproduction will be presented. Furthermore, an in-depth examination of the main judicial discussion involving surplus embryos and the Resolutions that regulate their destination will be conducted. Finally, it seeks to understand the role of bioethics and biolaw for the debate on a topic so relevant to the constitution of a family in today's society. | pt_BR |
