Resumo
A liberdade de expressão, um direito constitucional essencial para o Estado Democrático de Direito, por possibilitar a existência de uma sociedade plural em que as ideias são livremente discutidas e passíveis de análise por quaisquer pessoas, pode ser exercida independentemente de censura ou de licença. Assim, com os avanços tecnológicos e a popularização da internet, as redes sociais conquistaram posição central para referida liberdade, fazendo emergir o debate acerca da moderação de conteúdo por parte das plataformas. Deste modo, a presente pesquisa tem o propósito de identificar se as técnicas de moderação de conteúdo podem se configurar como censura e descobrir qual a influência e os riscos resultantes da utilização da filtragem algorítmica filter bubble na formação de opinião e na liberdade de expressão. Para tanto, a pesquisa desenvolveu-se através da abordagem qualitativa e a coleta de dados por meio da pesquisa bibliográfica e documental, com consulta na legislação e doutrina nacional e internacional. Concluiu-se que a moderação de conteúdo pode ser considerada como censura e que o uso da filtragem algorítmica possui grande influência na formação de opinião e, consequentemente, na liberdade expressão, pois restringe as informações que são mostradas ao usuário e ele passa saber e opinar somente sobre um viés – aquele que a plataforma quer. Existindo, dessa forma, a governança privada das mídias sociais, que modulam, a partir de seus interesses e das técnicas de moderação, o comportamento de seus usuários.
Freedom of expression, an essential constitutional right for the Democratic State of Law, as it enables the existence of a plural society in which ideas are freely discussed and subject to analysis by any person, can be exercised regardless of censorship or license. Thus, with technological advances and the popularization of the internet, social networks have gained a central position for said freedom, giving rise to the debate about content moderation by platforms. Thus, this research aims to identify whether content moderation techniques can be configured as censorship and discover the influence and risks resulting from the use of filter bubble algorithmic filtering in opinion formation and freedom of expression. Therefore, the research was developed through a qualitative approach and data collection through bibliographical and documental research, with consultation in national and international legislation and doctrine. It was concluded that content moderation can be considered as censorship and that the use of algorithmic filtering has a great influence on opinion formation and, consequently, on freedom of expression, as it restricts the information that is shown to the user and he passes on to know and give an opinion. only about one bias – the one the platform wants. Thus, there is the private governance of social media, which modulate, based on their interests and moderation techniques, the behavior of their users.
