dc.description.abstractO tema deste trabalho é o fenômeno do elo geográfico e sua relação com o encarceramento em massa da população negra no Brasil. Investigou-se o seguinte problema: A área na qual a pessoa acusada foi bordada ou reside é determinante para a condenação da população negra no Brasil? Cogitou-se as seguintes hipóteses: a discriminação estrutural no Brasil é sustentada a medida que o elo geográfico demonstra que os acusados, em sua maioria, moram em áreas periféricas, amplamente habitadas pela população negra, por esse motivo, representando uma falha processual. O objetivo geral é analisar se o que estamos chamando de elo geográfico é determinante para agravar a discriminação da população negra no processo conhecimento e de execução penal, de modo específico com o encarceramento em massa. Os objetivos específicos são: conceituar o que é encarceramento em massa, definindo as origens históricas, analisar a discriminação estrutural e institucional, pontuar quem é a população afetada, além de pesquisar sobre o papel institucional da Polícia, do Ministério Público e do Judiciário; discorrer sobre o processo de racialização dos espaços sociais, iniciando com o conceito de racialização, de segregação racial, apontando a dinâmica racial da segregação dos espaços, com os espaços de brancos e de negros, visando realizar a formulação do elo geográfico diante da realidade dos índices carcerários brasileiros, abordar sobre a psicologia racial da discriminação, tendo o estereotipo como parâmetro do preconceito, assim como o caráter político das características físicas nos espaços sociais, por fim alinhando-se as estatísticas brasileiras. Este trabalho é relevante por apresentar um trabalho específico sobre a discriminação da população negra no país associado ao elo geográfico, no qual aborda temas atuais para os profissionais da área jurídica, os quais poderão se valer das conclusões produzidas no presente trabalho, pelo que terão subsídios teóricos para possíveis embates; agrega à sociedade pelo fato de atestar a segurança jurídica, com a finalidade de proibir arbitrariedades por parte do Poder Público. dc.description.abstractThe theme of this work is the phenomenon of the geographical link and its relationship with the mass incarceration of the black population in Brazil.I investigated the following problem:Is the area in which the accused person was approached or resides is decisive for the condemnation of the black population in Brazil? I considered the following hypotheses: structural discrimination in Brazil is supported the extent to which the geographical link demonstrates that the accused, mostly, live in peripheral areas, widely inhabited by the black population, for this reason, representing a procedural failure. The general objective is to analyze whether what we are calling a geographical link is decisive in aggravating the discrimination of the black population in the criminal execution process, specifically with mass incarceration. The specific objectives are: to conceptualize what is mass incarceration, defining historical origins, analyzing structural and institutional discrimination, pointing out who is the affected population, in addition to researching the institutional role of the Police, the Public Prosecutor's Office and the Judiciary; discuss about the process of racialization of social spaces, starting with the concept of racialization, racial segregation, pointing out the racial dynamics of the space segregation, regarding the whites and blacks spaces. Aims the geographical link formulation before the reality of Brazilian prison indexes, address on the racial psychology of discrimination, with the stereotype as a parameter of prejudice , as well as the political character of physical characteristics in social spaces, finally aligning the Brazilian statistics. This work is relevant because it presents a specific work on the discrimination of the black population in the country associated with the geographical link, in which it addresses current themes for legal professionals, who may avail themselves of the conclusions produced in the present work, so that they will have theoretical subsidies for possible clashes; adds to society by attesting legal certainty, with the purpose of prohibiting arbitrariness on the part of the Public Power.
