Direitos sexuais e direitos reprodutivos: a importância da tutela desses direitos por meio de uma convenção interamericana

| dc.description.abstract | O presente artigo foi desenvolvido com a finalidade de entender as tratativas que envolveram o projeto por uma Convenção Interamericana de Direitos Sexuais e de Direitos Reprodutivos, na primeira década do século XXI. Para isso, buscou-se, primeiramente, entender como foram e quais foram as definições atribuídas aos direitos sexuais e aos direitos reprodutivos, abordando as nuances que, hoje, afetam a tutela e a evolução da proteção desses direitos no cenário brasileiro. Foram demonstradas diversas situações em que se pode identificar que a ausência da proteção desses direitos pelo Estado Brasileiro traz diversas violações aos Direitos Humanos, inclusive, colocando em risco o direito à vida de diversos sujeitos. Para desenvolver esse trabalho, foram realizadas análises documentais, bem como um trabalho investigativo, que tiveram como objetivo entender os sujeitos participantes, o cenário das tratativas entre os grupos sociais e a Organização dos Estados Americanos (OEA) e o resultado dessa mobilização por uma Convenção Interamericana. Diante dessa análise não foi possível identificar, contudo, o motivo pelo qual a convenção não foi finalizada. Tratou-se, ainda, sobre a importância e a influência de normativas internacionais na esfera do contexto jurídico brasileiro, com a análise do caso “Maria da Penha Maia Fernandes” (Caso 12.051 da Comissão Interamericana de Direitos Humanos) como uma espécie de paradigma, para auxiliar na análise desses efeitos de uma convenção concreta no âmbito interregional. | pt_BR |
| dc.description.abstract | This article was developed with the purpose of understanding the negotiations that involved the project through an inter-American convention on sexual and reproductive rights. For this, firstly, we sought to understand how they were and what the definitions attributed to sexual and reproductive rights were, addressing the nuances that today affect the tutelage and the evolution of the protection of these rights in the Brazilian scenario. Several situations were demonstrated which identify that the lack of protection of these rights by the Brazilian State causes several violations of human rights, including, putting at risk the right to life of several people. In order to develop this work, analyses of several documents were carried out, as well as investigative work, with the purpose of understanding the scenario of the people involved, the negotiations between social groups and the Organization of American States (OAS), and the result of this mobilization by an Inter-American Convention. Given this analysis, however, it is not possible to identify the reason why the convention was not finalized. It also dealt with the importance and influence of international regulations in the sphere of the Brazilian legal context, with the analysis of the case “Maria da Penha Maia Fernandes” (Case 12.051 of Inter American Commission on Human Rights) as a kind of paradigm, to assist in the analysis of these effects in a concrete way. | pt_BR |
