A edição genética em seres humanos é um tema cada vez mais discutido e, ganhou
um tom urgente quando, em 2018, foi anunciado o primeiro nascimento de bebês geneticamente
modificados na China. Diante disso, muito se questionou a falta de discussão pública e
transparência quanto a este tipo de pesquisa, bem como as lacunas jurídicas e fiscalizatórias
que corroboraram com tal acontecimento. O presente artigo tem como escopo abranger os
aspectos jurídicos que permeiam a edição genética na linha germinal, por meio de uma
comparação entre os cenários regulatórios do Brasil e da China; e avaliar a necessidade e a
possibilidade da criação de um órgão internacional. Para desenvolver o objetivo proposto, foi
utilizado o método qualitativo de abordagem, mediante pesquisa documental sobre o assunto.
Como resultado, foi apurado a provável falta de eficácia de um órgão internacional diante de
um tema tão complexo e controverso, sendo métodos alternativos o estabelecimento de
estruturas básicas para diferentes tipos de governanças, bem como estimular e estender a
discussão sobre o tema, para que os regulamentos e diretrizes sejam condizentes com a opinião
pública e tragam maior segurança à humanidade.
Human gene editing is a topic that has been increasingly discussed topic and took on an urgent tone when, in 2018, the first birth of genetically modified babies in China was announced. In view of this, much was questioned about the lack of public discussion and transparency regarding this type of research, as well as the legal and inspection loopholes that corroborated this event. The purpose of this article is to cover legal aspects that permeate gene editing in the germ line, through a comparison between the Brazilian and Chinese regulatory scenarios; and to evaluate the need and the possibility of creating an international body. To develop the proposed objective, the qualitative approach method was used, through documentary research on the subject. As a result, the probable lack of effectiveness of an international body in the face of such complex and controversial issue was found, with alternative methods being the establishment of basic structures for different types of governance, as well as stimulating and extending the discussion on the subject, so that the regulation and guidelines are consistent with public opinion and bring greater security to humanity.
