dc.description.abstractO objetivo deste estudo é analisar as mudanças introduzidas pela Lei n.º 14.112/2020 nas normas de recuperação judicial, com foco na sua aplicação ao produtor rural pessoa física. Para alcançar esse objetivo, foram delineados os seguintes objetivos específicos: contextualizar as normas de recuperação judicial no Brasil; identificar as principais etapas e critérios que o produtor rural pessoa física deve cumprir para que seja possível ingressar com um processo de recuperação judicial; e verificar se as novas prerrogativas legais são suficentes para atenuar o impacto da crise que tem afetado esse segmento. Assim, escolheu-se como metodologia a revisão bibliográfica, de cunho qualitativo, mediante uma abordagem investigativa e dedutiva das teorias, legislações pertinentes e decisões dos tribunais superiores. Os resultados apontam que a Lei n.º 14.112/2020 trouxe maior segurança jurídica aos produtores rurais, ao legalizar a situação dessa categoria, mas ainda há necessidade de mais estudos e discussões para uma maior compreensão do processo, especialmente porque a normativa é recente. No entanto, conclui-se que com a alteração legal, a recuperação judicial mostra-se como uma ferramenta importante para ajudar os produtores rurais a enfrentar dificuldades financeiras e superar crises.
dc.description.abstractThe purpose of this study is to analyze the changes introduced by Law n.º 14.112/2020 in the rules of judicial recovery, with a focus on their application to individual rural producers. To achieve this goal, the following specific objectives were outlined: to contextualize the rules of judicial recovery in Brazil; to identify the main stages and criteria that the individual rural producer must meet to file for judicial recovery; and to verify whether the new legal prerogatives are sufficient to mitigate the impact of the crisis that has affected this segment. Thus, a bibliographic review was chosen as the methodology, with a qualitative approach through an investigative and deductive analysis of theories, pertinent legislation, and decisions of higher courts. The results indicate that Law n.º 14.112/2020 brought greater legal certainty to rural producers by legalizing their situation, but further studies and discussions are still needed for a better understanding of the process, especially because the normative is recent. However, it is concluded that with the legal amendment, judicial recovery proves to be an important tool to help rural producers face financial difficulties and overcome crises.
