Resumo
O matrimônio, base fundamental do Direito de Família, atua como personagem
principal entre as famílias brasileiras e seus membros. Dentre as consequências do
matrimônio, está o efeito patrimonial. Tal efeito patrimonial no casamento é moldado
de acordo com o regime de bens escolhido pelo casal. Dentre os regimes, o mais
adotado entre os cônjuges, é o regime de comunhão parcial de bens. Este regime é
considerado pela doutrina e pelo legislador o mais igualitário de todos, dividindo o
patrimônio adquirido durante o casamento em três categorias principais, sendo estas
o patrimônio de cada cônjuge e o patrimônio comum. Já que o objetivo do matrimônio
é a comunhão de vida e interesses, principalmente a construção e sustento de uma
família, o patrimônio construído pelo casal é um dos tópicos mais discutidos e
controversos durante o rompimento conjugal e no divórcio. Pensando nisso, o
presente trabalho apresenta a divisão do que se entende hoje na doutrina e na
jurisprudência por bens comuns e bens particulares dentro do regime de comunhão
parcial, inclusive quanto os proventos do trabalho de cada cônjuge (Fundo de Garantia
do Tempo de Serviço e previdência privada), esclarecendo, por fim, o atual processo
de partilha de bens.
The matrimony, as a fundamental basis of Family Law, acts as an important character inside many Brazilians families e its members. As one of the many consequences of matrimony, there is the patrimonial effect. This patrimonial effect it’s molded accord antly by the property regime chosen by the married couple. As one of the regimes, the one most chosen is the partial community property regime. The doctrine and the leg islator consider this regime the most egalitarian of all, dividing the property acquired by the married couple during the marriage by three main categories, being the property of each spouse and the common property. Being that the main objective of marriage is the common interests, mainly to build and maintain a family, the property acquired by the couple is one of the main topics discussed during the divorce. With that in mind, the present dissertation presents the division of what is meant by today in the doctrine and Brazilian’s jurisprudence as the common property and the individual property in the partial community property regime, including the earnings of each other’s work, clarifying, at last, today’s process of property share.
