Resumo
O presente trabalho tem por objetivo, primeiramente, analisar os impactos que a pandemia do vírus da COVID-19 causou nas relações de trabalho, para isso, fez-se necessário entender o conceito de pandemia, bem como toda sua repercussão histórica pelo mundo. Foi analisado a origem do coronavírus, onde surgiu, como se desenvolveu, e a partir de que momento as contaminações começaram a se distribuir pelo mundo, nos levando a uma pandemia. Também, buscou-se entender as repercussões econômicas e financeiras, que consequentemente influenciaram as empresas e os trabalhadores. Desta forma, foram analisadas todas as Leis e Medidas Provisórias criadas para preservar à saúde pública e auxiliar nas relações de trabalho, com objetivo de manter os contratos de trabalho, gerar menos desemprego e dar a oportunidade para as empresas permanecerem com o seu funcionamento, sem uma possível falência. Além disso, foi analisada a possibilidade de caracterização de força maior, caso fortuito e fato do príncipe nas relações de trabalho diante da pandemia, sendo que, de primeiro modo, buscou destacar os conceitos de cada um, bem como a diferença entre força maior e caso fortuito, diferenciação essa que não é definida no ramo trabalhista, pois engloba dentro de força maior ambos os conceitos. Em seguida procurou entender sobre a possibilidade de aplicação do fato do príncipe, mediante a situação vivenciada, bem como, a possibilidade de responsabilização do Estado pelas consequências e rescisões dos contratos de trabalho devido a pandemia, e por fim, verificou-se qual entendimento jurisprudencial nesses casos.
The present work aims, firstly, to analyze the impacts that the COVID-19 virus pandemic has caused in the work relationships, for that, it was necessary to understand the pandemic concept, as well as all its historical repercussions around the world. The origin of the coronavirus was analyzed, where it appeared, how it developed, from which moment the contamination began to spread around the world, leading us to a pandemic. Also, we sought to understand the economic and financial repercussions, which consequently influenced companies and workers. In this way, all Laws and Provisional Measures created to preserve public health and assist in labor relations were analyzed, with the objective of maintaining employment contracts, generating less unemployment and giving the opportunity for companies to remain with their operation, without a possible bankruptcy. In addition, the possibility of characterization of force majeure, fortuitous event and Factum Principis in labor relations in the face of the pandemic was analyzed, and, first, it sought to highlight the concepts of each, as well as the difference between force majeure and fortuitous case, a differentiation that is not defined in the labor branch, encompassing both concepts within force majeure. Then, it sought to understand about the possibility of applying the fact of the prince according to the situation experienced, if it is possible to hold the State responsible for the consequences and termination of employment contracts due to the pandemic, and finally, it was verified which understanding the Courts have adopted in these cases.
