O objetivo do presente trabalho é abordar os principais aspectos do interrogatório
infantil por meio do Depoimento Sem Dano ou Especial, a fim de compreender o seu conceito,
sua aplicabilidade, procedibilidade e consequências na vida do depoente. Visa-se levantar os
principais aspectos jurisdicionais, no que tange os princípios constitucionais, pautando-se na
Constituição Federal de 1988, que protege a criança e o adolescente, bem como os aspectos
trazidos pelo Estatuto da Criança e do Adolescente e às modificações legislativas, de acordo
com a Lei nº 8,069. Serão analisados inicialmente os princípios basilares constitucionais, como
o da Proteção Integral no que se refere a sua função e efetividade, compreendendo a sua
necessidade perante a hipervulnerabilidade do menor e sua inserção no meio social, abordando
os aspectos principais quanto a sua objetificação no corpo social. Em seguida, verificar-se-á a
importância de tal forma inquisitiva visando afastar o menor da chamada revitimização,
compreendendo tal conceito. Posteriormente, serão levantados os principais aspectos que
exprimiram a necessidade da existência do Depoimento Sem Dano, bem como os principais
procedimentos desta forma de inquirição. Sob tal ótica, serão levantados os principais pontos e
questionamentos referentes aos profissionais envolvidos, tanto sob o aspecto jurídico, quanto
ao que se refere aos profissionais interdisciplinares e sua atuação, pautando suas principais
dificuldades. Ao final, passa-se à discussão objeto do estudo em tela, trazendo os principais
benefícios e malefícios do Depoimento Especial, questionando-se a efetividade jurisdicional de
tal forma no interrogatório infantil.
This academic work seeks to study the main aspects of the child hearing through the Testimony without Damage or Special Testimony, in order to comprehend its concept, applicability, the proceeding and the consequences in the life of the affiant. This work aims to present the main jurisdictional aspects, regarding the constitutional principles, based on the Federal Constitution of 1988, which protect the children and adolescents, as well as the aspects brought by The Statute of Child and Adolescent (“Estatuto da Criança e do Adolescente”) and the legislative modifications, in accordance with the Law n. 8.069. Initially, the basic constitutional principles will be analyzed, such as the Integral Protection, concerning their function and effectiveness, understanding their need in view of the hyper vulnerability of the minor and its insertion in the social environment, addressing the main aspects regarding the insertion in the social body. Then, it will be verified the importance of such an inquisitive tool in order to keep the minor away from the so-called re-victimization, understanding its concept. Subsequently, the main aspects that expressed the need for the Testimony Without Damage, as well as the main procedures of this kind of inquiry, will be raised. From this perspective, the main points and questions related to the professionals involved will be presented, both from a legal point of view, as well as with regard to interdisciplinary professionals and their performance, establishing their main difficulties. At the end, the core object of the study is discussed, introducing the main benefits and harms that can be caused by the Special Testimony, questioning the jurisdictional effectiveness of such form of child interrogation.
