Importância e obstáculos enfrentados pela Defensoria Pública do Estado de São Paulo para a consecução das funções constitucionais

Resumo
O objetivo do presente trabalho é analisar minuciosamente cada uma das limitações sofridas
pela Defensoria, e posteriormente, demonstrar a respeito da problemática prática consequencial
às mitigações, além de elencar possível soluções para uma maior valorização da Instituição.
O principal método utilizado para a referida pesquisa foi a análise minuciosa de uma série de
Ações Diretas de Inconstitucionalidade, logo a análise predominantemente foi a jurisprudencial
de julgados do Supremo Tribunal Federal tratando das mitigações às prerrogativas de um
defensor público. Além disso, também houve a busca pelo entendimento doutrinário a respeito
de cada uma das prerrogativas, entendendo o porquê delas existirem e a primordial observância
a ser feita em relação a elas. Também há uma análise de estatísticas através de pesquisas
realizadas por diversos órgãos relacionados à Instituição visando primordialmente trazer em
números a discrepância que há entre a carreira de um defensor público e as demais carreiras
jurídicas, principalmente no que diz respeito à Magistratura e ao Ministério Público.
Por fim, a pesquisa constatou que de fato há uma grande discrepância no que se refere ao
tratamento propiciado à Defensoria Pública quando comparado aos demais órgãos da Justiça.
Tanto no quesito estrutural, onde vislumbra-se um menor financiamento à Instituição, quanto
do ponto de visto jurisprudencial, por meio da propositura de diversas ações que buscam a todo
instante mitigar as prerrogativas de um defensor público.
Despite the constitutional provision listing the Public Defender's Office as an essential body for the functions of justice, there is still a discrepant treatment provided to the Institution when compared to other Legal Careers. The limitations occur both in the structural scope of the Institution and with the filing of Direct Actions of Unconstitutionality mitigating the constitutional prerogatives of public defenders. The objective of the present work is to analyze in detail each of the limitations suffered by the Defender's Office, and later, demonstrate about the practical problems consequent to mitigations, in addition to listing possible solutions for a greater appreciation of the Institution. The main method used for this research was the thorough analysis of a series of Direct Actions of Unconstitutionality, so the analysis was predominantly the jurisprudence of judgments of the Federal Supreme Court dealing with mitigations to the prerogatives of a public defender. In addition, there was also a search for doctrinal understanding about each of the prerogatives, I understand why they exist and the primordial observance to be made in relation to them. And there is also a statistical analysis through research carried out by various bodies related to the Institution aiming primarily to bring in numbers about the discrepancy that exists between the career of a public defender and other legal careers, especially with regard to the Judiciary and the Ministry Public. Finally, the research found that in fact there is a large discrepancy with regard to the treatment provided to the Public Defender's Office when compared to other justice bodies. Both in terms of structure, where there is clearly less funding for the Institution, and from a jurisprudential point of view, in which several actions seek at all times to mitigate the prerogatives of a public defender.
