Abstract
O Direito é uma ferramenta de solução de conflitos desenvolvida pela sociedade ao longo da história. O sistema direito seja estatal ou privado recebe conflitos, processa-os e devolve sentenças. Além disso, o direito garante pela força a execução destas sentenças, a espada de Themis.Este trabalho concentra-se porém, na mão direita da deusa, na balança, no método jurisprudencial de avaliar o fato através da norma para gerar a sentença. Para ser coeso, integro e justo este método depende não só de leis e precedentes, mas de normas abertas, ligadas a valores e fins, os princípios. Princípios trazem coesão ao sistema, pois em seu cerne está a moral justa que sustenta a sentença e o uso da força. O peso dos princípios é maior em sistemas em formação, autoregulados, autocompostos e internacionais pois a dimensão da sanção possui menor alcance. O presente trabalho apresenta a tenra formação dos princípios no ramo do Direito da Construção Internacional. Para isso, inicialmente, analisa-se a natureza e formação de princípios gerais do Direito e posteriormente, a formação dos princípios do comércio internacional e da Lex Mercatoria, materializada nos Princípios Unidroit. Por fim, examina-se a indústria da construção, suas particularidades, seus contratos específicos, a arbitragem no âmbito da construção e a recente divulgação de uma lista de princípios em um artigo de 1997 pelo advogado e árbitro Charles Molineaux.O trabalho advoga por uma maior identificação e consolidação destes princípios de forma a criar precedentes e segurança jurídica no ramo da arbitragem da construção internacional.
Law is a conflict resolution tool developed by society throughout history. The legal system, whether state or private, receives the disputes, executes them and pronounces judgments. Furthermore, law guarantees the enforcement of these sentences, by Themis's sword. This work focuses although, on the right hand of the goddess, on the scale, on the jurisprudence method to evaluate facts though norm in order to create sentences. To be coherent, perfect and fair, this method depends not only on laws and precedents, but on open norms, values and objectives, guided by principles. Principles bring cohesion to the system, because at its heart is the morality that sustains the opinion and the employment of the force. The weight of principles is greater in formed, self-organizing, self-composed, and international systems because the sanction has a smaller reach. The present work presents the young formation of principles in the field of International Construction Jurisprudence. To do so, initially, the nature and formation of the general principles of the Law are explained and later, the formation of the principles of international trade and Lex Mercatoria, which materializes in the Unidroit principles, finally, examines the construction industry, and its own particularities, contracts, construction arbitration environment, and its recent release of a list of principles in a 1997 article by Charles Molineaux. This work stands for the identification and consolidation of these principles in order to create precedents and legal certainty in the field of international construction arbitration.
