As medidas socioeducativas tradicionais, que variam de simples advertência à internação em unidade educativa, carecem de uma profunda reflexão que objetive a real mudança de comportamento do adolescente em conflito com a lei. As medidas hoje em voga não costumam estimular a reflexão pessoal do adolescente sobre a conduta ilícita praticada, tampouco o levam a uma maturidade suficiente capaz de fazê-lo reconhecer o próprio erro e perceber o dano que causou a alguém. Em resumo, as medidas socioeducativas precisam de técnicas capazes de gerar transformação social, sob pena de continuarem inadequadas para gerar a inclusão social do adolescente que praticou ato infracional. Nesse sentido, objetiva-se com o presente trabalho, através da leitura de artigos e trabalhos, refletir sobre a possibilidade de aplicação da Justiça Restaurativa em prol dos adolescentes em conflito com a lei, bem como analisar seu potencial para alcançar a inclusão social destes, pois o processo restaurativo busca o resgate das relações sociais e tem como foco principal a mudança dos paradigmas de convívio em sociedade, sendo uma justiça mais humana, voltada à construção de responsabilidades individuais, servindo como uma alternativa ao paradigma punitivo.
Traditional socio-educational measures, ranging from a simple warning to admission to an educational unit, lack a reflective character that aims to a real change in the behavior of adolescents in conflict with the law. In addition, these measures do not usually stimulate the adolescent's personal reflection on an unlawful conduct, nor do they make them recognize their mistake and perceive the damage they have caused to others. In summary, socio-educational measures lack techniques capable of generating social transformation, in addition to not being the most appropriate way to generate social inclusion for the adolescent who committed an infraction. In this sense, the objective of the present work is to explain about the possibility of applying Restorative Justice in favor of adolescents in conflict with the law, as well as analyzing their potential to generate social inclusion for them, as the restorative process seeks to rescue social relationships and has as its main focus changing the paradigms of living in society, creating a more human justice, aimed at the construction of individual responsibilities, serving as an alternative to the punitive paradigm.
