A utilização indiscriminada de agrotóxicos na agricultura brasileira e a violação dos direitos fundamentais à alimentação saudável, saúde, informação e ao meio ambiente equilibrado sob a ótica da ausência de transparência na comercialização de alimentos produzidos com agroquímicos e o conflito de interesses políticos e econômicos em relação aos direitos e garantias fundamentais da sociedade brasileira. Propõe-se Conhecer o processo de modernização agrícola através da chamada Revolução Verde e seus impactos, políticos, sociais e ambientais. Analisar o panorama da legislação vigente e a utilização de agrotóxicos no País. O estudo baseia-se em pesquisas bibliográficas, na análise empírica da legislação e as problemáticas decorrentes do consumo e manuseio de pesticidas e a manutenção de direitos e garantias fundamentais através do método hipotético-dedutivo. A análise mostra o favorecimento político do agronegócio e a necessidade de reavaliar a legislação atual e a instituição de novas políticas públicas. Conclui-se com hipóteses acerca da ineficácia do Estado em aplicar as normas constitucionais e a necessidade de aplicação de novo modelo de negócio na agricultura que priorize a agroecologia e os pequenos produtores.
The indiscriminate use of agrochemicals in the Brazilian agriculture and the violation of the fundamental rights to healthy feeding, health, information and to the well balanced environment under the optics of the absence of transparency in the commercialization of food produced with agrochemicals and the political and economical conflict of interest on regarding the fundamental rights and warranties of the Brazilian society. It is proposed to get the knowledge of the agricultural modernization process through the named Green Revolution and its political, social and environmental impacts. Analysis of the current legislation panorama and, the use of agrochemicals in the country. The study is based on bibliographical researches, empirical legislation analysis and the resulting problems from the consumption and handling of pesticides and the maintaining of the rights and fundamental warranties thought the deductive hypothetical method. The analysis reveals the political favoritism of the agribusiness and the reevaluation need of the current legislation and the setup of new public policy. It is concluded with hypotheses about the State inefficiency to enforce the constitutional norms and the need of application of a new agriculture business model that prioritizes the agroecology and the small producers.
