Abstract
SARS-CoV-2 é uma infecção que potencializa a Síndrome Respiratória Aguda Grave, cuja qual foi de distribuição global. Devido à propagação global e ao estado de calamidade provocado no Brasil e no mundo, foi declarado pela OMS, a pandemia por COVID-19. O seu acometimento em gestantes está associado a diversas repercussões, como o parto prematuro, óbito fetal, abortamento. Para tanto, o presente trabalho tem como objetivo analisar a Responsabilidade Civil no evento morte em partos pré-termos causados em decorrência da COVID-19. O Estudo examina como se enquadra a erro médico, especificamente na triagem das gestantes que comparecem aos Hospitais privados com sintomas leves do coronavírus, tais como febre e tosse, e não recebem a devida atenção do médico, sendo negligentes ao não encaminharem a paciente ao acompanhamento pré-natal, bem como demais aferições de exames. Neste estudo, de abordagem essencialmente teórica, o método de pesquisa utilizado foi o bibliográfico e a técnica de pesquisa foi a documentação indireta.

Due to the global spread and the state of calamity caused in Brazil and in the world, it was declared by the WHO, the pandemic by COVID-19. Its involvement in pregnant women is associated with several repercussions, such as premature birth, fetal death, abortion. Therefore, the present work aims to analyze Civil Liability in the event of death in preterm births caused as a result of COVID-19. The Study examines how medical malpractice fits, specifically in the screening of pregnant women who attend private hospitals with mild symptoms of the coronavirus, such as fever and cough, and do not receive due attention from the doctor, being negligent in not referring the patient to follow-up. prenatal care, as well as other exam measurements. In this study, with an essentially theoretical approach, the research method used was bibliographic and the research technique was indirect documentation.
