Este trabalho apresenta uma análise sobre a importância da participação feminina na política e
a dificuldade do preenchimento da cota mínima de 30% (trinta por cento) para qualquer um dos
sexos nos partidos políticos, prevista no artigo 10, parágrafo 3o da Lei nº 9.504/97. A partir da
abordagem do movimento pelo sufrágio feminino no Brasil e, por meio da observação de sua
evolução histórica, buscou-se examinar os contextos em que se fez necessária a inclusão da
mulher na política, com o direito de votar e de ser votada, como forma de garantir o direito
fundamental da igualdade entre homens e mulheres. Neste contexto, destaca-se a relevância da
atuação dos partidos políticos para a proteção deste direito, ressaltando a necessidade do
preenchimento das cotas de gênero e da reserva de fundo partidário para que as mulheres
possam ter campanhas competitivas, e dessa forma, possam favorecer a aprovação de políticas
públicas e leis com o enfoque no público feminimo e na proteção da mulher no Brasil. Ainda,
estes estudos objetivam analisar o que leva os partidos a fraudarem as cotas de gênero com
candidaturas que assumem uma função ou responsabilidade no papel, mas não na prática, as
conhecidas candidatas laranjas, e destacar a imprescindibilidade da atuação estatal para a
punição desses esquemas de corrupção
This paper presents an analysis of women’s participation in the political domain and the difficulties to reach the minimum quota of 30% for both genders within political parties, provided by the Article 10, Paragraph 3rd of law 9.504/97. Through an approach based on the movement in favor of women’s suffrage in Brazil and by observing its historical evolution, this analysis has been proposed as a mean to find out the context in which women’s suffrage is necessary, including the right to vote and to be voted in order to ensure the fundamental right of gender equality. In this perspective, the importance lies in the actions adopted by the by political parties in order to protect this right, emphasizing the need to fill gender quota as well as the party reserve fund. So as to enable women as a mean to have more competitive campaigns in order to enhance public policy approval and laws devoted to women and their protection. Furthermore, this paper also aims at analyzing what motivates parties to commit public fraud in quotas devoted to gender equality through candidatures that take this responsibility in theory, but not in practice. These candidatures are launched on behalf of candidates known as “straw men”. This research, therefore, emphasizes the absolute need for state actions to punish these corruption schemes
