Abstract
O aquecimento global e as mudanças climáticas antropogênicas são problemas que assolam a
civilização como um todo. No entanto, percebe-se um comedido ímpeto dos principais atores
responsáveis pelos problemas climáticos, quais sejam entes privados e públicos, para o
enfrentamento desse desafio. Diversas foram as tentativas de negociações internacionais sobre
o clima e meio ambiente, tendo sido estipulados, além de diversos acordos e tratados, os
Objetivos de Desenvolvimento Sustentáveis, com prazo de cumprimento previsto para 2030.
Os Objetivos 13 e 16, de especial relevância para o presente trabalho, se referem à tomada de
medidas urgentes para a mitigação das mudanças climáticas e à garantia de acesso à justiça a
todos, respectivamente. Nesse contexto, diante dos insuficientes esforços empenhados até o
presente momento, é possível afirmar que a Litigância Climática atua como ferramenta eficiente
para a mitigação das mudanças do clima, conforme estabelecido no ODS13?? Para alcançar a
resposta do problema proposto, foi utilizado o método dedutivo, aliado à investigação
bibliográfica e documental, tendo como objetivo geral analisar se a Litigância do Clima
associada à cooperação internacional são métodos de combate e enfrentamento das mudanças
climáticas de modo a alcançar a Justiça Climática. Como forma de auxílio na compreensão do
tema proposto, objetivos específicos foram delineados, quais sejam: compreender o que são as
mudanças climáticas e seus efeitos; analisar o histórico da preocupação internacional com o
clima e meio ambiente e, por fim, compreender o que é o Constitucionalismo Climático e a
Justiça Climática, ressaltando sua importância frente ao combate das mudanças climáticas.
Nesse escopo, foi possível concluir que tanto a Litigância, quanto a Justiça Climática são
ferramentas aptas para o enfrentamento das mudanças do clima e os desafios dela decorrentes,
uma vez que o Direito tem se apresentado como protagonista nas demandas em nível global e
local para a obtenção de respostas aos efeitos negativos dos problemas enfrentados. Assim, a
Justiça Climática, como objetivo, é fundamentada pelo Constitucionalismo Climático e
amparada pela Litigância Climática como meio para ser alcançada.

However, there has been little impetus from the main players responsible for climate problems, both private and public, to tackle this challenge. There have been several attempts at international negotiations on climate and the environment and, in addition to various agreements and treaties, the Sustainable Development Goals have been stipulated, with a deadline of 2030. Goals 13 and 16, of particular relevance to this work, refer to taking urgent measures to mitigate climate change and guaranteeing access to justice for all, respectively. In this context, given the insufficient efforts made to date, is it possible to say that Climate Litigation acts as an efficient tool for mitigating climate change, as established in SDG 13? In order to reach the answer to the proposed problem, the deductive method was used, combined with bibliographic and documentary research, with the general objective of analyzing whether Climate Litigation associated with international cooperation are methods of combating and confronting climate change in order to achieve Climate Justice. To help understand the proposed theme, specific objectives were outlined, namely: to understand what climate change is and its effects; to analyze the history of international concern with the climate and the environment and, finally, to understand what Climate Constitutionalism and Climate Justice are, highlighting their importance in combating climate change. In this context, it was possible to conclude that both Litigation and Climate Justice are suitable tools for dealing with climate change and the challenges it poses, since the Law has been a protagonist in demands at a global and local level for answers to the negative effects of the problems faced. Thus, Climate Justice, as an objective, is based on Climate Constitutionalism and supported by Climate Litigation as a means of achieving it.
