| dc.description.abstract | O presente trabalho objetiva esmiuçar a temática da gestação de substituição no que tange à insuficiência normativa no Brasil a partir de conceituações provenientes do âmbito jurídico, aliadas a estudos principiológicos suscitados pela prática e análises legislativas, no contexto da Reprodução Medicamente Assistida, sobretudo mediante a realização de pesquisas bibliográficas e documentais, além de consultas jurisprudenciais as quais possibilitem um entendimento mais preciso sobre o assunto em tela. Compreender-se-á o tratamento normativo proporcionado pelo ordenamento jurídico brasileiro à luz dos elementos basilares para a construção da cessão temporária de útero, considerando a importância conferida pela Constituição Federal de 1988 aos princípios – tidos como normas de valor imprescindíveis à completude do ordenamento jurídico – em equiparação às regras, e demonstrando-se a insuficiência das hodiernas diretrizes, tendo em vista não somente a complexidade do tema, bem como sua incidência sobre variadas áreas do conhecimento. Ao serem assimiladas as repercussões jurídicas da lacuna legislativa no contexto nacional, concluir-se-á pela emergente necessidade da regulamentação legislativa, aliada ao estímulo de discussões producentes como essencial à função do próprio Direito, levando em conta a garantia de harmonia e segurança jurídica concernentes ao corpo social. | dc.description.abstract | The present work aims to scrutinize the topic of gestational surrogacy regarding the normative insufficiency in Brazil, based on conceptualizations from the legal field, combined with principle studies raised by the practice and legislative analysis, in the context of Medically Assisted Reproduction, especially through the making of bibliographical and documentary research, in addition to jurisprudential consultations which enable a more precise understanding of the subject at hand. The normative treatment provided by the Brazilian legal system will be understood in light of the basic elements for the construction of surrogacy, considering the importance given by the Federal Constitution of 1988 to principles – considered norms of essential value to the completeness of the legal system – in comparison with rules, and demonstrating the insufficiency of the current guidelines, considering not only the complexity of the topic, as well as its impact on various areas of knowledge. When assimilating the legal repercussions of the legislative gap in the national context, it will be concluded that there is an emerging need for legislative regulation, combined with the encouragement of productive discussions as essential to the function of the Law itself, taking into account the guarantee of harmony and legal security concerning society. It strives for the creation of a legislation that is consistent with the reality observed in the country. | pt_BR |
