O presente estudo tem o escopo de analisar a possibilidade de a criminalização do aborto, tipificado no ordenamento jurídico penal brasileiro por intermédio dos artigos 124 e 126 do Código Penal, caracterizar uma forma de violência contra mulher. Dessa forma, analisou-se o contexto histórico do aborto no mundo e no Brasil, compreendendo-se a tipificação do aborto na legislação brasileira e confrontando-o com a realidade enfrentada pelas mulheres que se submetem aos procedimentos abortivos clandestinos e inseguros, bem como analisando-o numa perspectiva da saúde e direitos garantidos às mulheres pela Constituição Federal de 1988 e pelas Convenções Internacionais, do qual o Brasil é signatário, além disso, refletindo na perspectiva da marginalização das mulheres que já se encontram em evidente vulnerabilidade social e econômica. Além disso, buscou-se apresentar os sistemas alternativos à legislação brasileira, por meio do qual alguns países legalizaram a interrupção voluntária da gestação, oferecendo métodos seguros e garantindo o livre exercício dos direitos das mulheres no que diz respeito à saúde, liberdade, autonomia privado, sexualidade e reprodução feminina. A metodologia utilizada foi o método bibliográfico, através de pesquisa de artigos, monografias, dissertações, relatórios, dados, legislações, convenções internacionais e jurisprudência.
The present study aims to analyze the possibility that the criminalization of abortion, typified in the Brazilian criminal legal system through articles 124 and 126 of the Penal Code, characterizes a form of violence against women. Thus, the historical context of abortion in the world and in Brazil was analyzed, understanding the typification of abortion in Brazilian legislation and confronting it with the reality faced by women who undergo clandestine and unsafe abortion procedures, as well as analyzing it in a perspective of health and rights guaranteed to women by the Federal Constitution of 1988 and by the International Conventions, of which Brazil is a signatory, in addition, reflecting in the perspective of the marginalization of women who are already in evident social and economic vulnerability. In addition, we sought to present alternative systems to Brazilian legislation, through which some countries have legalized voluntary termination of pregnancy, offering safe methods, and guaranteeing the free exercise of women's rights regarding health, freedom, private autonomy, sexuality and female reproduction. The methodology used was the bibliographic method, through research of articles, monographs, dissertations, reports, data, legislation, international conventions, and jurisprudence.
