Diante da ilegitimidade e fracasso do sistema penal, como o abolicionismo penal aborda a inexistência das prisões e punições penais? O abolicionismo, especialmente no Brasil, possui camadas ainda frágeis, porém em constante crescimento. A busca por formas de solução de conflitos que, de fato, solucionem os problemas deveria ser o foco tanto de abolicionistas quanto de pessoas que não se enquadram nessa corrente político-criminal radical. Pensando nisso, o objetivo deste artigo é identificar como o abolicionismo penal é discutido no Brasil, utilizando-se o método de pesquisa bibliográfica para traçar o estado da arte trazido por autores e autoras que estudaram os diferentes elementos que compõem a realidade brasileira, além da eventual possibilidade de extinção do sistema penal. Por meio da pesquisa, concluiu-se que, embora exista uma quantidade de conteúdo considerável sobre o tema, há poucas propostas concretas voltadas à perspectiva brasileira, o que denota a necessidade de se aprofundar tanto nas análises teóricas quanto práticas.
Faced with the illegitimacy and failure of the penal system, how does penal abolitionism address the non-existence of prisons and criminal punishments? Abolitionism, especially in Brazil, has layers that are still fragile, but are constantly growing. The search for ways to resolve conflicts that, in fact, solve problems should be the focus of both abolitionists and people who do not fit into this radical political-criminal current. With this in mind, the objective of this article is to identify how penal abolitionism is approached in Brazil, using the bibliographical research method to outline the state of the art brought by authors who studied the different elements that make up the Brazilian reality, in addition to the possibility of extinction of the penal system. Through research, it was concluded that, although there is a considerable amount of content on the topic, there are few concrete proposals focused on the Brazilian perspective, which denotes the need to delve deeper into both theoretical and practical analyses.
