Esta pesquisa trouxe como propósito investigar a foma de atuação relapsa da empresa Braskem e a falta de confiabilidade da legislação ambiental no Brasil e seu impacto, principalmente no que se refere ao funcionamento dos poderes legislativo, judiciário e executivo no contexto das consequências negativas. Essas implicações prejudicaram o bem-estar social, desconsiderando um dos direitos primordiais estabelecidos na Constituição Brasileira: o direito à moradia conforme delineado no Artigo 6º. Além disso, buscou-se compreender a dinâmica dessas consequências adversas e os riscos enfrentados pela população residente nos bairros afetados e em regiões adjacentes de Maceió, através da Teoria de Bem-Estar de John Maynard Keynes. A singularidade deste tema reside na conexão entre problemas ambientais decorrentes de atividades industriais específicas, suas implicações sociais, urbanas, jurídicas e políticas, explorando um dos maiores desastres causados ao meio ambiente advindos da empresa Braskem que se eximiu de suas responsabilidades, e que teve sua tragédia abscôndito pelas mídeas de comunicação. A originalidade deste tema foi atribuída a exploração da externalidade negativa e responsabilidade corporativa, na investigação do impacto social e urbano e na abordagem das consequências jurídicas. O cerne dos resultados desta pesquisa revelaram o impacto provocado pela atuação da Braskem. Manifestou a necessidade imediata de medidas enérgicas para estabelecer regulamentações mais robustas, tomando como base os princípios de Keynes. É inadiável que o Estado assuma uma postura proativa, impondo normas ambientais mais rigorosa, com o compromisso ambiental seguro, equitativo e sustentável.
This research aims to investigate Braskem's negligent actions and the lack of reliability in Brazil's environmental legislation and its impact, particularly concerning the functioning of the legislative, judiciary, and executive branches in the context of negative consequences. These implications have harmed social welfare, disregarding one of the fundamental rights established in the Brazilian Constitution: the right to housing as outlined in Article 6. Additionally, it seeks to understand the dynamics of these adverse consequences and the risks faced by the population residing in affected neighborhoods and adjacent regions of Maceió, using John Maynard Keynes' Welfare Theory. The uniqueness of this theme lies in the connection between environmental issues stemming from specific industrial activities, their social, urban, legal, and political implications, exploring one of the most significant environmental disasters caused by Braskem, which absolved itself of responsibilities and had its tragedy concealed by media outlets. The originality of this theme is attributed to the exploration of negative externality and corporate responsibility, investigating social and urban impacts, and addressing legal consequences. The core of the findings from this research reveals the impact caused by Braskem's actions. It underscores the immediate need for robust measures to establish more stringent regulations, drawing upon Keynesian principles. It is imperative for the State to adopt a proactive stance, enforcing stricter environmental norms, aiming for an environmentally secure, equitable, and sustainable commitment.
