Online dispute resolution potencializado pela inteligência artificial: uma abordagem tecnológica centrada no ser humano

| dc.description.abstract | A realidade atual está inserida em um ambiente on-line, no qual as pessoas trabalham, estudam, relacionam-se, fazem compras e realizam as mais diversas atividades pela internet. No entanto, a internet não é um ambiente harmonioso. Na verdade, o conflito é algo natural e que ocorre e ocorrerá em qualquer ambiente de convívio entre pessoas, seja presencialmente ou por meio de uma plataforma on-line. Considerando essa realidade, especialmente em um país como o Brasil, onde a judicialização é extremamente elevada, a busca por meios extrajudiciais de resolução de disputas se torna algo necessário. Especialmente para disputas originárias de transações realizadas por meio da internet, o Online Dispute Resolution (ODR) já é utilizado em grande escala e gera bons resultados. Neste trabalho é realizado o estudo da potencialização do ODR por meio da inteligência artificial (IA), com o objetivo de verificar se isso pode representar um benefício efetivo aos envolvidos na disputa, às empresas que disponibilizam as plataformas digitais e ao Estado. É dedicada uma atenção especial ao estudo do efeito do ODR e da IA na ampliação do acesso à justiça, bem como aos benefícios econômicos e ao aspecto humano no sentido da importância do oferecimento de uma boa experiência àquele que enfrente um conflito e necessita de um meio simples e acessível para resolver o seu problema, sendo a tecnologia um instrumento para essa consecução e não um fim em si mesma. Também são analisadas as limitações e problemas que podem advir do uso da IA em ODR, mas o estudo mostra que isso não deve ser interpretado como uma barreira ao seu progresso, mas sim como oportunidades para melhorias e inovação, promovendo um equilíbrio entre eficiência e sensibilidade às complexidades das disputas humanas. É demonstrado, ainda, que o sucesso do uso da IA em ODR, provavelmente, reside em uma abordagem construtiva que garanta que a tecnologia evolua para viabilizar uma estrutura de resolução de disputas mais justa e eficaz. | |

| local.description.abstracten | The current reality is embedded in an online environment where people work, study, interact, shop, and perform a variety of activities over the internet. However, the internet is not a harmonious environment. In fact, conflict is a natural occurrence and will happen in any environment where people coexist, whether in person or through an online platform. Considering this reality, especially in a country like Brazil, where judicialization is extremely high, the search for extrajudicial means of dispute resolution becomes necessary. Particularly for disputes arising from transactions conducted over the internet, Online Dispute Resolution (ODR) is already widely used and yields good results. This study explores the enhancement of ODR through artificial intelligence (AI) with the objective of verifying whether this can represent an effective benefit to the parties involved in the dispute, the companies providing the digital platforms, and the State. Special attention is given to studying the effect of ODR and AI on expanding access to justice, as well as the economic benefits and the human aspect in terms of the importance of offering a good experience to those facing a conflict and needing a simple and accessible means to resolve their issue, with technology being an instrument for this achievement and not an end in itself. The limitations and problems that may arise from the use of AI in ODR are also analyzed, but the study shows that this should not be interpreted as a barrier to its progress, but rather as opportunities for improvement and innovation, promoting a balance between efficiency and sensitivity to the complexities of human disputes. It is also demonstrated that the success of using AI in ODR likely lies in a constructive approach that ensures the technology evolves to enable a fairer and more effective dispute resolution structure. | |
