O presente trabalho tem como objetivo a análise das políticas concorrenciais no setor
financeiro, a fim de apontar as barreias e dificuldades enfrentadas pelas Fintechs nesse
ambiente, utilizando-se do estudo de caso da Guiabolso. Para tanto, inicialmente, será
apresentado um breve estudo entre os parâmetros considerados para medir a concorrência neste
setor, relacionando esta com concentração, poder de mercado e o spread bancário. Ainda, serão
apresentados critérios práticos utilizados pelo Conselho Administrativo de Defesa Econômica
(CADE) para autorização de operações entre instituições financeiras. Em seguida, será
realizada uma breve introdução histórica da reforma do setor financeiro na década de noventa,
até as inovações e novos posicionamentos do Banco Central do Brasil (BACEN) para incentivar
a concorrência no setor. Disto posto, será analisada a competência do CADE e do BACEN para
dirimir os conflitos e tomar decisões quanto às práticas concorrenciais no sistema financeiro.
Adicionalmente, serão objeto de estudo do presente trabalho, as próprias Fintechs,
considerando seu aparecimento histórico e suas peculiaridades. Também serão analisados os
decretos de regulamentação do BACEN sobre o tema e seu desenvolvimento, cumulando na
análise das principais dificuldades enfrentadas pelas Fintechs atualmente para entrarem e se
estabelecerem no mercado financeiro. Por fim, será realizado o estudo do caso Guiabolso contra
o Bradesco, que tramitou no CADE, analisando quatro pontos principais: (i) a infração à ordem
econômica; (ii) o sigilo bancário; (iii) a dependência das Fintechs aos bancos tradicionais; e
(iv) a consequência aos consumidores.
The present work aims to analyze the competitive policies in the financial sector, in order to point out the barriers and difficulties faced by Fintechs in this environment using the case study of Guiabolso. To this end, initially, a brief study will be presented among the parameters considered in the competitive policies in this sector, relating competition, concentration, market power and spread. Practical criteria used by Administrative Council for Economic Defense (CADE) to authorize transactions between financial institutions will also be presented. Then there will be a brief historical introduction to the reform of the financial sector in the nineties, until the innovations and new positions of Central Bank of Brazil (BACEN) to encourage competition in the sector. That said, the competence of CADE and BACEN to resolve conflicts and make decisions regarding competitive practices on the financial system will be analyzed. Additionally, the Fintechs themselves will be the object of study in this work, considering their historical appearance and their peculiarities. BACEN regulatory decrees on the topic and its development will also be analyzed, adding to the analysis of the main difficulties faced by Fintechs today to enter and establish themselves in the financial market. Finally, the Guiabolso case study against Bradesco will be carried out, which was judged at CADE, analyzing four main points: (i) the economic order; (ii) bank secrecy; (iii) the dependence of Fintechs on traditional banks; and (iv) the consequence for consumers.
