dc.description.abstractO estudo em tela tem o objetivo de analisar o princípio da segurança jurídica e sua importância para a discussão e o amadurecimento da autoridade da coisa julgada e seus reflexos no âmbito tributário. Desse modo, a relevância do estudo consiste em analisar quais as hipóteses em que são cabíveis a relativização da coisa julgada, mas, por outro lado, sopesar como tal relativização poderá ocorrer sem violar o princípio da segurança jurídica. Nesse cenário, é necessário entender as delimitações desse instituto, bem como os meios para se relativizar a coisa julgada e os efeitos decorrentes desta. Após, será discutido o papel do Poder Judiciário, principalmente dos entendimentos do Superior Tribunal Federal acerca do tema, haja vista sua qualidade de garantidor do texto constitucional e, consequentemente, do princípio da segurança jurídica.pt_BR
dc.description.abstractThe study aims to analyze the principle of legal security and its importance for the discussion and maturation of the res judicata authority and its consequences in the tax sphere. Thus, the relevance of the study consists in analyzing the hypotheses in which the relativization of res judicata is applicable, but, on the other hand, to consider how such relativization can occur without violating the principle of legal security. In this scenario, it is necessary to understand the delimitations of this institute, as well as the means to relativize the res judicata and the effects that result from it. Afterwards, the role of the Judiciary will be discussed, especially the understandings of the Federal Supreme Court on the matter, given its quality as guarantor of the constitutional text and, consequently, of the principle of legal security.pt_BR
