Este trabalho aborda o dano moral ambiental coletivo e seu respaldo legal no sistema normativo
brasileiro. A pesquisa fundamenta-se na perspectiva da responsabilidade civil na doutrina
brasileira, detalhando os aspectos relevantes da reparação civil do dano ambiental, com foco
específico no dano moral coletivo ambiental. A educação ambiental desempenha papel crucial
ao possibilitar o reconhecimento do caráter coletivo do meio ambiente e sua proteção, uma vez
que os danos ambientais afetam toda a sociedade. Para tanto, leis foram promulgadas visando
responsabilizar por danos, reparar prejuízos e conscientizar sobre a relevância da preservação
ambiental. A metodologia abrange uma pesquisa bibliográfica na legislação, na doutrina e na
jurisprudência pátria. Além disso, esta monografia realiza uma análise das fundamentações
jurídicas presentes em decisões do Supremo Tribunal Federal no período de 2021 a 2023,
investigando o conteúdo dessas fundamentações no que concerne a identificação do dano moral
ambiental coletivo.
This work addresses collective environmental moral damage and its legal support in the Brazilian normative system. The research is based on the perspective of civil liability in Brazilian doctrine, detailing relevant aspects of civil reparation for environmental damage, with a specific focus on collective environmental moral damage. Environmental education plays a crucial role in enabling the recognition of the collective nature of the environment and its protection, since environmental damages affect society as a whole. To this end, laws have been promulgated to hold accountable for damages, repair losses, and raise awareness about the importance of environmental preservation. The methodology includes bibliographic research in legislation, doctrine, and national jurisprudence. In addition, this monograph analyzes the legal foundations present in decisions of the Supreme Federal Court from 2021 to 2023, investigating the content of these foundations regarding the recognition of collective environmental moral damage.
