Resumo
O presente trabalho tem por objetivo investigar as funções da pena no contexto dos crimes de colarinho branco, uma categoria diversificada de delitos econômicos, financeiros e empresariais cometidos por indivíduos de elevada estima social e poderio econômico, geralmente executados no âmbito de suas atividades profissionais. Através do confronto entre teoria e prática, a pesquisa examina minuciosamente as funções da pena, quais sejam a retribuição, prevenção e ressocialização, no contexto dos crimes de colarinho branco. Concluindo-se que, em suas acepções tradicionais, mostram-se inadequadas para o enfrentamento desses delitos, resultando senão na insuficiência e descompasso que se assiste atualmente no Direito Penal. Deste modo, reconhecendo a complexidade desses delitos e a defasagem do Direito tradicional em lidar com estes, o presente estudo propõe a adoção de penas alternativas e da justiça penal negociada como abordagens eficazes para combater os crimes de colarinho branco, uma vez que essas medidas mostram-se mais hábeis na ponderação das particularidades apresentadas no âmbito dos crimes de colarinho branco. Além disso, relembra-se que o Direito Penal é ultima ratio, fato pelo qual insiste que a mudança só será efetiva se toda sociedade e o Estado compreender as particularidades da delinquência econômica, empreendendo esforços conjuntos para seu enfrentamento. Essas abordagens inovadoras visam preencher a lacuna entre a complexidade dos crimes de colarinho branco e as estratégias tradicionais de justiça penal, destacando-se, nesse sentido, a necessidade de uma adaptação do sistema legal para lidar com esses crimes de maneira mais eficaz, promovendo ao mesmo tempo a equidade e a justiça na sociedade contemporânea.
The present essay aims to examine the purposes of punishment for white-collar crimes, which refer to a variety of economic, financial, and business offenses committed by individuals of high social status and economic influence within their professional capacities. Through a critical analysis of theory and practice, this study comprehensively explores the roles of punishment, including retribution, prevention, and resocialization, in the realm of white-collar crimes. The study concludes that traditional interpretations of these concepts fall short in addressing the multifaceted nature of such offenses, leading to inadequacies and imbalances within the criminal justice system. Recognizing the complexity of white-collar crimes and the inadequacies of traditional criminal law in addressing them, this study suggests implementing alternative penalties and negotiated criminal justice as effective strategies to combat these crimes. These measures have demonstrated the ability to carefully consider the unique characteristics of white-collar crimes and offer a promising approach. Moreover, it is crucial to note that Criminal Law should only be utilized as a last resort. Thus, effective change can only occur if society and the State comprehend the characteristics of economic misconduct and cooperate to fight it. These novel methods aim to connect the disparity between white-collar crimes' complexities and traditional criminal justice tactics. The research emphasizes the necessity of modifying the legal system to address these crimes effectively and foster fairness and justice in modern-day society.
