Resumo
Este trabalho aborda a ponderação necessária entre o artigo 7º, inciso XXXIII, da
Constituição Federal, que proíbe o trabalho para menores de dezesseis anos, exceto para os
aprendizes, e o artigo 8, da Convenção n. 138, da Organização Internacional do Trabalho, que
autoriza o trabalho artístico infantil, bem como o artigo 5º, inciso IX, da Constituição Federal,
que assegura a livre expressão da atividade artística. A análise crítica se debruça sobre os
prejuízos que o trabalho na infância pode acarretar ao desenvolvimento integral da criança e
do adolescente, violando os seus direitos fundamentais positivados no artigo 227, da
Constituição Federal, como à saúde, à educação, ao lazer, à dignidade, ao respeito e à
convivência familiar e comunitária. Apesar da proibição constitucional e dos potenciais danos
à integridade física, psicológica e moral da criança e do adolescente, é comum encontrá-las
em manifestações artísticas, principalmente como influencers digitais mirins, tendo em vista a
prática recorrente de autorizações judiciais. Diante disso, defende-se a aplicação rigorosa do
princípio da proteção integral, com a implementação de medidas de fiscalização mais efetivas
e a participação ativa das famílias, da sociedade e do Estado, no combate à exploração do
trabalho infantil. Dessa forma, a partir de uma análise bibliográfica e jurisprudencial, a
pesquisa busca demonstrar a importância de assegurar à criança e ao adolescente os seus
direitos fundamentais nas autorizações, para que prevaleçam sobre os interesses comerciais.
The study addresses the necessary balance between Article 7, item XXXIII, of the Federal Constitution, which prohibits work for minors under sixteen years of age, except for apprentices, and Article 8 of Convention No. 138 of the International Labour Organization, which authorizes artistic work by children, as well as Article 5, item IX, of the Federal Constitution, which ensures the free expression of artistic activity. The critical analysis focuses on the damages that work in childhood can cause to the full development of the child and adolescent, violating their fundamental rights enshrined in Article 227 of the Federal Constitution, such as health, education, leisure, dignity, respect, and family and community life. Despite the constitutional prohibition and potential harm to the physical, psychological, and moral integrity of children and adolescents, it is common to find them in artistic manifestations, mainly as young digital influencers, in view of the recurrent practice of judicial authorizations. In light of this, the study advocates for the rigorous application of the principle of full protection, with the implementation of more effective inspection measures and the active participation of families, society, and the State, in combating the exploitation of child labor. Thus, through a bibliographic and jurisprudential analysis, the research seeks to demonstrate the importance of ensuring that children and adolescents' fundamental rights are secured in authorizations, so that they prevail over commercial interests.
