Resumo
A presente pesquisa expõe a análise das mudanças processuais trazidas pelo ordenamento jurídico brasileiro em relação ao negócio jurídico processual na execução, seja na fase de cumprimento de sentença ou na execução de título extrajudicial. Nesse sentido, o assunto é abordado pela novidade trazida pelo artigo 190 do Código de Processo Civil de 2015, uma vez que as partes litigantes passaram a ter mais autonomia cooperativa na regulação do procedimento executivo com o fito de melhor satisfazerem os seus interesses sem que a burocracia e a solenidade das normas jurídicas, bem como o enrijecimento dos métodos típicos impedissem a efetividade do princípio do respeito ao autorregramento da vontade no processo, tendo-se em vista que o artigo supracitado oferta uma cláusula geral aos sujeitos envolvidos. Ademais, o trabalho apresenta os princípios que fundamentam a respectiva dinâmica, além de verificar quais os limites a serem observados para que o negócio jurídico processual atípico seja válido e não haja abusividade no acordo entabulado entre as partes.
The present article exposes the analysis of the procedural changes brought by the Brazilian legal system in relation to the procedural legal business in the execution, whether in the execution phase of the sentence or in the execution of an extrajudicial title. In this sense, the subject is precisely due to the novelty brought by article 190 of the Code of Civil Procedure of 2015, since the disputing parties now have more cooperative autonomy in the regulation of the executive procedure with the aim of better feeling their interests without the the obligation and solemnity of legal norms, as well as the stiffening of typical methods, prevented obedience to the principle of respect for the self-regulation of the will in the process, bearing in mind that the aforementioned article offers a general clause to the subjects involved. In addition, the work presents the principles that underlie the respective dynamics, in addition to verifying the limits to be observed so that the atypical procedural legal transaction is valid and there is no abusiveness in the agreement entered into between the parties.
