O presente trabalho procura analisar os indivíduos com transtorno de personalidade antissocial, publicamente conhecidos como psicopatas ou sociopatas e, dessa forma, considerar, dentro do Sistema Penal Brasileiro, se tais indivíduos devem ser inimputáveis ou não, ou seja, se a eles se aplicam medidas de segurança ou penas punitivas como, por exemplo, prisão. A definição e nomenclatura de pessoas que carregam esse transtorno, ao longo dos anos, passou por várias reformulações, uma vez que a psicologia e neurociência avançaram nos estudos e, cada vez mais, descobriram características mentais e comportamentais desses indivíduos. A partir disso, iremos analisar os estudos mencionados e as perspectivas científicas e psicológicas ao longo dos anos. Começamos por médicos como Philippe Pinel e António Damásio, e psiquiatras como Hervey Cleckley, além de analisar James Fallon, um neurocientista que descobriu carregar esse transtorno e analisar o cérebro de tais indivíduos. Por fim, iremos estudar o artigo 26 do Código Penal Brasileiro, que trata sobre os agentes inimputáveis e as hipóteses em que se consideram essas pessoas. Conclui-se que, a eles, cabe medida de segurança, diversamente às penas privativas de liberdade. Ademais, para fundamentar essa conclusão, iremos analisar a culpabilidade, que é pressuposto do delito, e a periculosidade, que é a probabilidade de um indivíduo praticar um crime e é o critério de aplicação das medidas de segurança, também previstas no Código Penal Brasileiro.

To conclude that they are entitled to a security measure, as opposed to custodial sentences. Furthermore, to support this conclusion, we will analyze culpability, which is a presupposition of the crime, and dangerousness, which is the probability of an individual committing a crime and is the criterion for the application of security measures, also provided for in the Brazilian Penal Code.
