dc.description.abstractO presente trabalho possui como objetivo analisar a perspectiva do testamento vital no panorama jurídico brasileiro, com enfoque na regulação acerca do assunto, sua aplicabilidade e os limites impostos. De início, temos a conceituação doutrinária, seguido pelo contexto estrangeiro em que foi criado, as resoluções que norteiam o tema no Brasil e o exame de eventuais jurisprudências brasileiras. Ao final, avaliamos as consequências da pandemia de Covid-19 para o tema e os possíveis efeitos do testamento vital se fosse integralmente legítimo através de uma norma específica.pt_BR
dc.description.abstractThe present study aims to analyze the perspective of living will in the Brazilian jurisdiction focusing on the terminal patient, the regulation about the topic, its applicability and the imposed limits. Firstly, we present the historical concepts, followed by the foreign context it was created in, the resolutions followed in Brazil and the analysis of ocasional Brazilian jurisprudence, the patient’s constitutional rights and the current applicability of the living. In the end, we evaluate the consequences of the Covid-19 pandemic for the theme and the possible effects of the living will if it was entirely accepted in Brazil by a specific law.pt_BR
